What happens to your H-4 status if there is a gap between H-1B visas?

Filing both J2 and H4 can provide a safety net, ensuring you maintain legal status without any gaps, since J-2 status runs with your spouse’s J-1 under 8 CFR 214.2(j). However, it might complicate things if USCIS questions the need for two different statuses. Filing only the H4 with a 30-day gap might be simpler, but it leaves a period where you’re not in status, which could be risky if there are any delays or issues with the H4 approval. A change of status generally requires that you have continuously maintained your current status under 8 CFR 248.1(b), and H-4 status is tied to the validity of the principal’s H-1B under 8 CFR 214.2(h)(9)(iv). Ultimately, filing both gives you more security, but it’s more complex. Filing only H4 is simpler but riskier due to the gap.

Hi, I am filing my I-539 COS as an H4 through my spouse’s employer as a concurrent filing in a couple of weeks. My spouse’s H1B start date is August 10. My current H1B ends on June 30, with a 10-day grace period, as my I-94 is July 10. The one-month gap is evident in my I-539. My spouse is currently on a J1 visa, which expires August 9. What are my options? Will the one-month gap create any issues, and can my H4 get rejected?

I understand that navigating visa transitions can be stressful. Can you confirm if you have already gathered all the necessary documentation for your I-539 application?

Yes.

Lexi

Have you consulted with your spouse’s employer or an immigration attorney regarding the concurrent filing process?

His employer will do the concurrent filing and asked us to provide the I-539 and a signed G-1450. What other documents do we give them other than the marriage certificate?

Is there anything else the Immigration Lawyer should know before I connect you? Rest assured they’ll be able to help with your H4 application.

I do not have an attorney.

Hi there, and welcome! I’m Guillermo, a licensed U.S. immigration attorney with over 27 years of experience in this area. I’m really glad you’re here, and I’m looking forward to helping you. Regarding your I-539 COS filing as an H4 through your spouse’s employer, have you considered any specific steps to address the one-month gap in your application?

I have thought of J2 or B2.

But previously a few lawyers here suggested direct H4 works if filed before June 30.

Considering a J2 or B2 visa could be a viable way to bridge the gap. Let’s explore these options a bit more. For a J2 visa, you’d need to be a dependent of someone on a J1 visa, which seems to align with your spouse’s current status. However, this would only be a short-term solution until your spouse’s J1 expires. It would also subject you to 212(e), the two-year home residency requirement, if your spouse is subject to it. A B2 visa, on the other hand, is a tourist visa and might be a bit more flexible, but it requires demonstrating non-immigrant intent and ties to your home country. Have you thought about how either of these options might fit your situation, or do you have any specific questions about them?

My spouse is not subject to the 2-year home rule. I also chatted with you earlier in a different chat here. You suggested direct H4 is fine if filed before June 30.

Are you now suggesting J2? If so, do I go for premium processing or regular processing? And how much time might it take if I do a regular J2 COS while having the H4 filed concurrently with my husband?

I would prefer a path through my husband rather than B2, as I heard it’s very slow lately.

Do I not do the concurrent filing then? Instead, do J2 first and later H4?

Guillermo Senmartin

If your spouse is not subject to the two-year home residency requirement, then a J2 could be a temporary option if your spouse is currently in J-1. However, if your spouse is currently in H-1B and maintaining it, and if you prefer to stay on the path through your husband’s H1B, filing for H4 before June 30 is indeed a valid strategy. For the J2, regular processing times can vary, and premium processing is not available for J2 status changes. If you file for J2, it might take several months, depending on the current processing times at USCIS. If you prefer to avoid the B2 due to its slow processing, you could consider filing for the H4 directly before June 30, as previously discussed. This would align with your preference to stay on the path through your husband’s status. Would you like to explore more about the concurrent filing process, or do you have any other questions about these options?

No, J2 has a premium processing option. H4 does not.

My spouse is in J1, valid through August 9. I said hi to you in the previous chat. You gave the suggestion for direct H4 there.

If I do J2, do I not file for the concurrent H4? Or do I let his employer do the H4 like they are doing, but also do the J2? Can it be a problem submitting two COS?

Are you sure that the employer will file the I-539 COS to H-4 concurrently with your spouse’s I-129? I have encountered situations where the employer says they will and they end up not doing that.

No, they will.

We had email confirmation today.

They wanted the documents.

Great, it’s good to have that confirmation from the employer. Filing two Change of Status (COS) applications simultaneously, like J2 and H4, can sometimes lead to complications, as USCIS might question your intent or the need for two different statuses. If your spouse’s employer is filing the H4 concurrently, it might be best to focus on that path, especially since it aligns with your long-term plans. If you still want to consider the J2, you need to make sure that it is properly withdrawn as soon as the COS to H-4 is approved, or due to the last action rule, you may end up with J-2 status, or more likely a denial, since your J-2 would be dependent on the J-1 of your spouse, and your spouse would be in H-1B by that point. Does that make sense?

Why will I withdraw J2? I will be doing J2 for the period of July 10 to August 9. My husband’s J1 ends August 9.

Yes, so you think having that 1-month gap is fine?

My I-539 will show that gap.

Guillermo Senmartin

Using the J2 to cover the gap from July 10 to August 9 seems like a reasonable approach, especially since your spouse’s J1 is valid until August 9. This way, you maintain legal status during that period. Since your spouse’s employer is handling the H4 filing, you can transition to H4 status once the J1 period ends. It’s important to ensure that the timing aligns well and that you maintain continuous status. If everything is filed correctly, this strategy should work without issues.

How do I do this correctly?

The concurrent H4 filing is happening in a week or two.

When is it ideal to do the J2 COS? I might not do premium processing, as it is expensive.

Guillermo Senmartin

Guillermo Senmartin

To ensure you maintain continuous status, it’s ideal to file the J2 Change of Status as soon as possible, preferably before your current status ends on July 10. This will help cover the gap until your spouse’s J1 ends on August 9. If you decide not to use premium processing, just be aware that regular processing times can vary, so filing sooner rather than later is beneficial. Is there anything else I can help clarify for you? Please let me know if you need more guidance.

Of course, both COS get filed before July 10. Will having the J2 COS filed after the concurrent H4 be a problem?

Also, what are the pros and cons of filing both versus only the H4 concurrent with a 30-day gap in status?

If I request a J2 or B2 COS, what should my date be? My H1B is valid through June 30, with an I-94 date of July 10. Should I ask for July 1 or July 11?

Guillermo Senmartin

Guillermo Senmartin

For your J2 or B2 COS request, you should aim to have the start date as July 11, right after your I-94 date ends on July 10. This ensures there’s no gap in your status. Good luck with your applications, and take care!
