[GA] How do I amend a Marital Settlement Agreement?

There is a spot that says we waive proceeds as a beneficiary of any type of insurance plan. I do not want to waive that part. Is there a way around that?

I understand your concern. Can you provide more details about the insurance plan in question?

Marital settlement agreement, irreconcilable differences.

Have you already signed any documents related to waiving proceeds as a beneficiary?

No.

Is there anything else the Lawyer should know before I connect you? Rest assured they’ll be able to help with beneficiary waiver.

No.

James

Hey there! Welcome to AskaLawyer. I’m James, an attorney with many years of experience. Just so you are aware, AskaLawyer is a legal information-only site. No attorney-client relationship is formed from our conversation. That being said, what do you hope for from this conversation?

In a marital settlement agreement, I don't want to waive the rights to proceeds as a beneficiary of any type of insurance policy.

James

Got it, thanks for sharing that. Could you let me know which state you’re in? Also, are you currently in the process of negotiating or drafting this marital settlement agreement?

In my paperwork, it is waiving those rights, but I don't want to do that.

Georgia.

Yes.

Drafting.

James

You can just draft a new agreement and omit that waiver. I understand your concern. Are you currently negotiating the terms of this agreement, or is it already drafted and ready for signing?

Already drafted.

James

You just don’t want to sign anything that indicates a waiver. You should draft a new document or amend the present version.

Thank you.

James

Here’s what you can do to address your concern about waiving rights to insurance proceeds in your marital settlement agreement:

1. Review the Agreement

  • Carefully read through the entire agreement to identify any clauses related to waiving rights to insurance proceeds. Make sure you understand the implications of these clauses.

2. Communicate with Your Attorney

  • If you have legal representation, discuss your concerns with your attorney. They can provide guidance on how to amend the agreement to reflect your wishes.

3. Propose an Amendment

  • You can propose an amendment to the agreement that specifically states you do not waive your rights to insurance proceeds. This can be done by drafting a new clause or modifying the existing one.

4. Negotiate with the Other Party

  • Engage in discussions with the other party involved in the agreement. Explain your position and why you wish to retain your rights as a beneficiary.

5. Seek Mediation if Necessary

  • If negotiations become difficult, consider seeking mediation. A neutral third party can help facilitate a resolution that satisfies both parties.

6. Finalize the Agreement

  • Once all parties agree on the changes, ensure the amended agreement is properly documented and signed by all involved.

Please let me know if you have further questions.

Thank you.

James

I hope I was able to help resolve your issue! If you have any other questions, feel free to ask.
