Which state do I use for a childcare POA?

On the form I just created, should the State be where the child is going (OK) or where I am getting the POA (SD)?

I understand that you're trying to determine the correct state for your form, which can be confusing. Is the Power of Attorney (POA) related to a specific legal matter or situation involving the child?

Ok

Are you currently residing in South Dakota, or is there another state where you are obtaining the POA?

Yes I am in SD but he is going to Oklahoma

Is there anything else the Lawyer should know before I connect you? Rest assured they'll be able to help with state jurisdiction.

Good afternoon and welcome to AskaLawyer. Please give me a moment to review your question. Note that I am a hearing impaired expert and so phone calls are difficult for me. Thank you for understanding. Just so you are aware, AskaLawyer is a legal information only site. I do not provide representation and no attorney-client relationship is formed. My answers and comments should not be considered legal advice. It is always best to hire a local attorney to review the specifics of your particular case to ensure that a proper review is conducted.

Ok

Should my form say Oklahoma or South Dakota? My son is moving from SD to OK

The Power of Attorney (POA) form should be executed under the laws of South Dakota, since that is where you, the parent or legal guardian, are currently residing and granting the authority. However, the form should clearly state that it grants authority for the child's care while they are residing in Oklahoma, and it must comply with Oklahoma’s recognition of out-of-state POAs involving minors. You may also wish to have the POA reviewed or filed in Oklahoma to ensure local institutions (like schools or doctors) will accept it without issue.

Is there guardianship paperwork on this website?

Legal Eagle

Yes - very easy to use.
