It is perfectly acceptable to have the deed created in New York and notarized in FL. It just needs to comply with NY law — executed in front of 2 witnesses and notarized. Your husband can also use an e-notary service to do it electronically. (NY Real Prop L § 299)

Hi. I'm in NY but my separated husband (soon to be divorced) is in Florida. I need to travel to him to get documents signed. The property I'm living in and asking him to sign is the Quit Claim form and it is in NY. Is it an issue if he signs the doc and we have it notarized in Florida where he lives? We have 2 homes and both assuming one each.
