It is perfectly acceptable to have the deed created in New York and notarized in FL. It just needs to comply with NY law — executed in front of 2 witnesses and notarized. Your husband can also use an e-notary service to do it electronically. (NY Real Prop L § 299)

I understand that you're looking to have a document notarized in a different state, which can be a bit confusing. Which states are involved in this notarization process?

The state my husband is in.

Hey there! I'm Lori, an attorney with many years of experience, and I'm here to help you. I understand that you're looking to have a document notarized in a different state, which can be a bit confusing. Can you tell me more about the states involved in this notarization process?

Hi. I'm in NY but my separated husband (soon to be divorced) is in Florida. I need to travel to him to get documents signed. The property I'm living in and asking him to sign is the Quit Claim form and it is in NY. Is it an issue if he signs the doc and we have it notarized in Florida where he lives? We have 2 homes and both assuming one each.

OK great thanks. Good to know about the e-notary service. So I would just need to have the 2 witnesses if he chooses that option?

Lori

Lori

Yes, but the notary can't be one of the witnesses.

Got it. Lastly, if I don't have a hard copy of the deed (he does) and I've requested it. Does the state or county have a copy on file?

Lori

Lori

Yes, you can get a copy from the county recorder's office.

Ok thanks for your help. That's all I needed.
