Solved

Connecticut employs an “enumerated services” model under Conn. Gen. Stat. § 12-407. This means sales tax applies only to specific services explicitly listed in the statute—everything else is exempt by default.

Taxable services include categories such as management consulting and business analysis, computer and data processing, employment and personnel services, and certain professional services like engineering and architectural services.

Since your remote product management subcontracting may be characterized as a business or consulting-type service performed while you are physically located in Connecticut, it could potentially fall within a taxable category unless a statutory exemption applies. The standard sales tax rate is 6.35%.

Connecticut generally determines tax liability based on the situs of the service, meaning the location where the service is performed. Because you are physically performing the work in Connecticut and have registered your business there as a foreign entity, the state may consider that you have established tax nexus.

If the service you provide is classified as a taxable enumerated service, you would need to register for a Connecticut Sales and Use Tax Permit through the myconneCT system, collect the tax on your invoices, and remit it to the Connecticut Department of Revenue Services.

If tax applies, it would normally be added to the invoice as a separate line item rather than included in your hourly rate.

I have a question on CT service tax.

I understand that dealing with service tax can be quite complex. Can you please specify what particular aspect of CT service tax you need assistance with?

I work as a remote product management subcontractor for a company headquartered in RI through a staffing agency located in MA, which is the direct contractor of the company that I work for. i.e., the company that I work as a product management subcontractor is a direct client of my staffing agency who pays me as 1099 income.

I work 40 hours and get paid $100 per hour from the staffing agency as a 1099 income, which is revenue to my LLC.

The LLC I have is registered in IL and I have elected as an S-corp, where I run my own payroll. However, I recently moved to CT and registered my company as foreign in CT. I am going to run my payroll from CT since I have moved to CT from IL. I will not be generating this 1099 income from IL. Since I now reside in CT, the 1099 income I generate is from me physically residing in CT.

I am not sure if I have to pay the service tax in CT and also whether I should bill my staffing agency with the CT service tax for my hourly rate?

What if the staffing agency is not happy with it and if they want to reduce my rate to adjust for the additional sales tax burden that they have to absorb? What can I do about it?

If the staffing agency wants to reduce your rate, that becomes a contract negotiation issue rather than a tax compliance issue.

Legally, if the service is taxable, the tax must be collected and remitted—you cannot waive or ignore that requirement. However, how the economic burden is handled between you and the agency is something that can be negotiated in your agreement.

You could clarify that the sales tax is a statutory charge separate from your service fee and should simply be passed through on the invoice. If they still insist on adjusting your rate, your options would be to renegotiate terms, accept a lower rate, or consider other contracting arrangements.

Got it, thank you.
