Should I sign a declaration of No Additional Insurance after a car accident where I was found to be at fault?

A Declaration of No Additional Insurance in the context of a car accident claim is a document typically used to confirm that the person involved in the accident does not have any other insurance coverage that could apply. So if you didn't have any other insurance that might possibly pay on any claim, then there is no harm in signing the form because it is entirely accurate. (18 U.S.C. § 1001)

You are simply agreeing that you don't have any other insurance. You aren't agreeing that you are liable for the wreck or that you caused it or that the other person caused it. You're just saying you don't have any other insurance.

I am being asked to sign a Declaration of No Additional Insurance for a car accident claim. At the time of the accident, I was insured by a car insurance provider. Now, I am insured by a different auto insurer. Should I sign this document? I have tried to reach out to my insurance adjuster, but she has never responded. Please help.

I understand that dealing with insurance claims can be stressful. Can you tell me if you have already submitted a claim to your original car insurance provider regarding the accident?

Yes.

Hello and welcome to the site! My name is Barrister and I am a licensed attorney, and I am here to help with your situation. I have read your post and I am sorry to hear you are having to deal with this situation, as I realize it can be frustrating and confusing.

Did you have any other insurance in place at the time of the accident?

No. It also states: “By execution of this document, I do not admit any liability whatsoever for causing said accident or being legally responsible therefore.”

Is this supposed to be how it is worded? The police at the scene said no one was at fault, but my insurance at the time said I am found to be at fault. I don't know if I should sign this.

Even if it says, “I do not admit any liability whatsoever for causing said accident or being legally responsible therefore,” when I have been found at fault?

I do not want to be committing perjury.

Just because your insurance company says you're at fault doesn't mean that legally you're at fault. That is just their opinion. Unless a judge and jury says you're liable, then you're not liable and you can say, you're not liable.

Even if you lost in court, you can still say you're not liable, if you believe you weren't liable.

Okay, thank you. This gives me some peace of mind in signing. Thank you for answering my questions.
