The short answer? A motion can work, but the safest move is to get the warrant recalled before 12/19/2025 so she can show up without being taken into custody. She should not walk into the clerk’s office again if they already warned she could be arrested there.

That’s the short answer, here’s the long answer: You want the judge to recall the bench warrant and reset the case on track, not to “pay it off at the window” while a warrant is still active. Metro Court can recall a warrant before a hearing in some cases, but they usually want a written request filed in the case and sometimes a brief setting to address it. Given her arrest and the stroke, you also want to put the medical facts in writing and ask for a non-custodial recall, meaning she appears voluntarily and the court recalls the warrant without jail. You can also request a court interpreter for your mother due to language needs so she can participate and avoid misunderstandings. Case and hearing info is on the statewide case lookup site: https://caselookup.nmcourts.gov/caselookup/

Here is what you can do legally, step-by-step:

  1. File a written “Motion to Recall Bench Warrant” (or “Motion to Quash/Recall Warrant”) in your case and ask for an order recalling the warrant before the 12/19/2025 hearing. Include the arrest, ambulance transport, stroke, and the clerk’s warning about being arrested if she returns in person. I have motion templates for sale for just $38. I can send a request to you through this site so you can accept and I can upload it right here.
  2. Attach medical paperwork showing the stroke and hospitalization, and ask the judge to handle the warrant on the paperwork or set a short hearing on the motion before 12/19/2025.
  3. Request language services for your mother for all hearings and paperwork so she has an interpreter. Use the court’s Language Access page: https://languageaccess.nmcourts.gov/
  4. If the court recalls the warrant, then address the underlying citations at the next court setting. Bring proof of current registration, insurance, and any fix-it documentation so you can ask to reduce or dismiss correctable items where allowed.
  5. If fines or fees become payable after the warrant is recalled or after the judge orders it, use the official NM Courts payment portal instead of going in person: https://payments.lexisnexis.com/newmexicocourtsonlinepayments/

I have a bench warrant issued for failing to appear on multiple traffic citations. I’ve already been arrested once on it and released, and now I finally have a new court date scheduled. I just want to resolve everything and avoid being arrested again. What’s the best way to handle this situation? Can I pay the citations or request anything from the court before the hearing to clear the warrant or reduce the risk of being taken into custody again?

What specific traffic citations are involved, and do you know if there are any additional penalties associated with them?

Improper display of registration plate, evidence of registration, failure to register or title a vehicle as required, no proof of insurance, and expired registration of a motor vehicle

Is there anything else the criminal lawyer should know before I connect you? Rest assured they’ll be able to help with your bench warrant.

Yes

Hello, I’m Legal Eagle. I’m an attorney who works in your area of law and I’ll help you sort this out today. I’ve read what you shared, so let’s go over what’s happening and what your best next steps look like.

Have you received any communication from the court or law enforcement regarding the bench warrant since your release?

No. So just to make this clear, this is for my mother who doesn’t speak any English and she’s with me now, but I’m trying to help her since we don’t really even know what’s going on. She had gone to pay the fees and whatever else she needed to pay to the county clerk, but that is when they arrested her on the spot for the warrant. When they were checking her vitals while they booked her, they saw she needed the hospital and they released her and sent her in an ambulance where she got a stroke. They had basically told her to turn herself in after she recovered, and when she called the clerk they told her to just show up to court that day because she would be arrested if she tried to go again to the clerk’s office.

Understood! So you're just wondering what you need to do here, correct?

Would a motion work to possibly get the warrant removed?

Legal Eagle

Legal Eagle

Ok, I’ve got what you're getting at here! Were there any other facts you'd like to add before I answer your question?

So I don’t know if you’ve pulled up the case, but as you see she kept posting bond after not appearing in court and she figured she’d do the same this time again for whatever reason, but this time never came and is when she was arrested for the warrant. But that would be about it to add.

Okay, sounds good. Thank you!

Does that help clarify things? I want to make sure I didn’t leave anything out.

This was very helpful actually. I would love to receive your motion templates to get the ball rolling.

Sure thing! I've taken the liberty of uploading one here. There is no charge.

Is it on your response above? Also, the motion is sent to the clerk’s office, and if so, how would I go about giving it to them?

Legal Eagle

Legal Eagle

Sure thing!

There are a few steps you need to take:

  1. Call the court clerk, and then set a hearing date for the motion.
  2. Once you have a hearing date, you can begin working on your motion.
  3. File the motion with the court clerk. Many courts allow you to do this online, or in person. You must check with the court.
  4. Once the document is filed, then serve the document. Someone over 18, and NOT a party to the case, must do it for you.
  5. Once the document is filed and served on the opposing party, they will have a chance to oppose the filing if they wish. The court will address all the papers at the scheduled hearing date and make a ruling.

Does that help clarify things? I want to make sure I didn’t leave anything out.

Just a little confused. If she already has her court hearing date on the 19th, then is this motion given to them on the 19th or prior to her going in?

Legal Eagle

You would file the motion before the 12/19/2025 hearing, so the judge can recall the warrant ahead of time and lower the risk of her being taken into custody when she shows up. If you wait until 12/19/2025, the court can still address it that day, but she may have to deal with the active warrant first, which is what you are trying to avoid given what happened when she tried to pay. I know this is confusing, but the safest path is to file it as soon as you can, ask for a recall order before the court date, and request an interpreter for your mother.

Okay awesome, you’ve been a great help.
