Unfortunately yes, you could be evicted based on the protective order. You would not need notice. (MI Comp L § 600.5714)

You would be able to obtain your belongings with a police escort. You can go to the department and they can go over with you. (MI Comp L § 600.5711)

I understand that facing eviction can be a stressful situation. Have you received any formal eviction notice from your landlord?

No.

Are you currently living in a rental property or is this related to a different type of housing situation?

Rental property.

Is there anything else the lawyer should know before I connect you? Rest assured they'll be able to help with your eviction issue.

No.

Please be patient if I do not respond within a few minutes as I may be completing another customer’s answer before getting back to this one, or may not be in front of my computer. Is there any additional information you think might be helpful?

You were served a protective order?

Yes. It was recently terminated after my ex wanted to have me out of our rental house.

Can I legally obtain my belongings from the property?

Is it legal for my ex to now determine when and how many times I can go to retrieve my things?

Dan

Dan

Yes it is, but you can also make requests through the court.

Do I have a chance at winning a civil suit with proof showing the PPO was filed to have me evicted?

Dan

Dan

Unfortunately no, the court awarded it, which would prevent the civil suit.

Is there anything I can do to obtain the money lost and taken over the matter?

Dan

Dan

If there is a divorce proceeding you can file through that. Or if you have an ownership interest in the home, you can sue for that.
I hope I was able to help resolve your issue! If you have any other questions, feel free to ask. Don't hesitate to reach out whenever you need assistance!

It's a rental property. And even though the court terminated this personal protection order (PPO) and she lied to the landlord about me being physically abusing her to obtain the eviction I have no say whatsoever in this?

Dan

Dan

You can fight the order. You absolutely have a right to contest it.

Thank you, I had the PPO terminated already.

Is a terminated PPO something anyone can look up?

Dan

Dan

Yes, it would be in the system.

How do I get it removed? I can't believe this is legal to do to someone. Can I legally possess a firearm?

Thank you for continuing to ask new questions, for additional questions please message on a new post.
