Do I still owe back rent if I left my apartment due to unsafe housing and my housing assistance has ended without notice?

Without the information I asked for in my request, I can only give you this general answer:

  • Explain to the property owner that you were in treatment and did not receive notice when the rapid rehousing funding ended, so you had no chance to address rent issues sooner. (42 U.S.C. § 1437f)
  • Describe the unsafe conditions you found when you returned, which led you to notify her that you could not stay, and clarify that you have no written records from the program or your landlord about these matters. (42 U.S.C. § 1437d)5
  • It may help to share any photos, emails, or other documentation you have showing the state of the property when you returned and summarize the steps you took to communicate your concerns.

Keeping communication honest and direct will help document your position if the dispute escalates or a formal decision is needed.

I went to inpatient treatment in July, at which time my rent was being paid through the rapid rehousing program. I was not notified that the funding had ended and that I owed rent for part of September, October, and November.

Upon arriving at my apartment, I did not have the correct key and walked around the building to see if I could get into the other entrance. There were tweakers all over and garbage everywhere, among other things, and I felt it was an incredibly unsafe environment for me.

So I sent an email to the property owner letting her know that I would not be returning to that unsafe environment. She wants to know how I want to proceed and when I will be paying for the back rent. I do not know how to handle this.

I'm sorry to hear about your difficult situation with your living environment and the unexpected rent issues. Can you tell me if you have any written communication regarding the rapid rehousing program and its funding status?

Since I was in treatment, she did not provide me with any written information on this situation.

Have you had any previous discussions with the property owner about your concerns regarding safety and your decision not to return?

Yes, that is when she asked me how I would like to proceed.
