Thank you for sharing these details. Your situation touches on several important legal concepts under American Samoa and California law.

Since you have confirmed your name is on the land title and deed in American Samoa, your ownership rights are secure under local law, which generally restricts land ownership to persons of Samoan descent or those who qualify under specific statutes. Because you inherited the land and have the title, you are not liable for rent or occupancy fees unless there is a separate lease or agreement with the family living on the property.

Regarding your concern about California back payments or taxes, you are not responsible for California property taxes or back payments on land located in American Samoa, as California law does not apply to real property outside its jurisdiction. (CA Rev & Tax Code § 405) The only potential tax obligation in California would be if you received income from the land (such as rent), which you have not, or if you sell the property and realize a capital gain. (CA Rev & Tax Code § 17041) Otherwise, your ownership of land in American Samoa does not create a California tax liability.

As for the family living on the land, you have the right to decide whether to allow them to remain, negotiate a lease, or request that they vacate. If they request that you sign over the land, you are under no obligation to do so unless you choose. (CA Civ Code § 1006)

If you decide to formalize their occupancy, you may wish to draft a written agreement to clarify terms and protect your interests.

I understand that navigating land ownership in another country can be quite complex. Have you already purchased the land in Samoa, or are you in the process of considering a purchase?

Inheritance since I was 18, I am now 38 and just recently learned about it.

Are you aware of any specific legal requirements or restrictions regarding foreign ownership of land in Samoa?

I am half Samoan and the land is in American Samoa, so I am legally (to my understanding) able to own the land.

Is there anything else the real estate lawyer should know before I connect you? Rest assured they'll be able to help with your inheritance issue.

No.

Thank you for the information. Given that the land is in American Samoa and you are eligible to own it, it is important to address the inheritance matter promptly.

Here are some steps you should consider:

  1. Verify the Inheritance: Obtain any documentation or records that confirm your inheritance rights. This may include a will, trust documents, or any legal declarations made by the previous owner.
  2. Legal Consultation: Consult with a lawyer who specializes in inheritance and property law, particularly with experience in American Samoa. They can provide guidance on the specific legal procedures and requirements.
  3. Probate Process: If the inheritance has not been legally transferred to you, it may be necessary to go through a probate process. This is a legal procedure to authenticate the will and transfer the property to the rightful heir.
  4. Title Search and Registration: Conduct a title search to ensure there are no other claims or encumbrances on the property. Once confirmed, ensure the property is registered in your name.
  5. Tax Obligations: Be aware of any tax obligations that may arise from the inheritance, both in American Samoa and potentially in California. Consulting with a tax advisor may be beneficial.
  6. Estate Planning: Consider engaging in estate planning to manage your assets effectively.

Taking these steps will help ensure that your rights to the property are secured and that you are in compliance with all legal requirements. If you need further assistance, please let me know.

Yes.

Good day and welcome. Please give me a moment to review your question. Note that I am a hearing impaired expert and so phone calls are difficult for me. Thank you for understanding. Just so you are aware, this is a legal information only site. I do not provide representation and no attorney-client relationship is formed. My answers and comments should not be considered legal advice. It is always best to hire a local attorney to review the specifics of your particular case to ensure that a proper review is conducted.

Ok, there are more details to this that I would like to talk with someone about.

Could you tell me more about the inheritance issue you're facing?

Ok, understood with the boilerplate. Thank you.

No rent has been paid (side fact). But I am concerned that since I learned about having the land in my name 3–4 years ago after my dad passed away, I don't want to be on the hook for any California back payments for land I didn't even know existed.

I have the land title and deed and already called the American Samoa land title office to confirm my name is on the title for the land. And I have a copy of that as well. I have the original loan payment documents and all of that as well, given to my parents from the bank.

Last year, the family who has been living on the land reached out requesting that I sign it over to them. I have told them that as of now, nothing will be changing as I figure out what I should do next.

If you need more information let me know. Or questions.
