Solved

Typically, after getting the affidavit of heirship signed and notarized, you would file it with the county clerk's office where the property is located (TN Code § 66-24-103). This helps to officially record the change in ownership. Once it's filed, you should receive a stamped copy for your records.

Affidavit of Heirship Form

I just filled out affidavit of heirship for Tennessee. My mom passed away July 6, 1995. Home still has a mortgage. I have to send it to them. Is there anything else I need to do?

I'm sorry to hear about your loss; it can be challenging to navigate these matters. Have you already contacted the mortgage company regarding the status of the mortgage after your mother's passing?

Yes, I informed them of her death, got them what they needed. They still need affidavit of heirship. I just filled it out to the best of my knowledge and all documents I needed information from.

Are there any other assets or debts that need to be addressed in addition to the home?

Everything in the house is paid for. She had medical bills and credit card bills and a loan, which I have been notifying and taking care of as they come in and I find out about them.

Hello. My name is Richard and I have been a licensed attorney for over 25 years and hope to be of assistance. I understand you're dealing with the affidavit of heirship for your mother's estate in Tennessee and the ongoing mortgage situation. Could you tell me more about any steps you've already taken regarding this matter?

I just finished filling out affidavit of heirship for Tennessee. I’ve been notifying debtors and taking care of them and sending them death certificates. Most of them they wrote off telling me I don’t have to do anything else—medical, credit cards, and a loan. The loan officer wrote it off and they wrote off medical bills and most of the credit card debt. There is still a mortgage on the house. Is there anything else I need to do?

It sounds like you've been very proactive in handling your mother's debts. Regarding the mortgage, have you been in contact with the mortgage company to discuss the possibility of assuming the mortgage or any other options they might offer? This could be important to prevent any foreclosure actions.

I know I need to send affidavit of heirship to mortgage company and get it signed and notarized. Do I need to file it at county office? That’s what the instructions told me.
