Solved

So I haven’t heard back from you in a while on this, which is no big deal! Without the information I asked for in my request, I can only give you this general answer:

You have a strong position to challenge this based on misrepresentation, since a “frame-off restoration” should not include significant frame rust. The inspection report and the seller’s statements both matter, so keep those along with your photos and repair findings organized. (TX Bus & Com Code § 17.46)

You can send a written demand to the seller outlining the condition you discovered, the prior representations, and what resolution you want, such as a partial refund or rescission. The third-party vehicle inspection service refund does not resolve the larger issue, but their report may still help show you relied on third-party confirmation.

As a next step, put your timeline and evidence into a simple, dated summary so you can present a consistent narrative when you escalate this.

I hope I was able to help resolve your issue! If you have any other questions, feel free to ask.

I purchased a ’55 T-Bird from a widow last summer. I live in Texas, and the car was in New York. I paid $29,000 for the car, and I bought it based on the fact that the car had received a frame-off restoration.

I understand how important it is to feel confident in a significant purchase like a classic car. Can you tell you if you have any documentation or proof regarding the restoration of the T-Bird?

Before closing the deal I hired a third-party vehicle inspection service to send out a representative who would evaluate the car. The tech came back with rave reviews of the car, saying it was the nicest he had seen.

Have you encountered any issues with the car since the purchase that you believe may be related to the restoration claims?

When I got the car, it died within 100 yards of my house. While checking the car out, I found a terrible rust problem along the frame. I kept all texts and documents, pictures, etc. I contacted the third-party vehicle inspection service, and they offered me my $360 or so back.

Is there anything else the consumer protection lawyer should know before I connect you? Rest assured, they will be able to help you with your rust problem.

No.

Hello, I’m Legal Eagle. I’m an attorney who works in your area of law and I’ll help you sort this out today. I’ve read what you shared, so let’s go over what’s happening and what your best next steps look like. What specific claims did the seller make about the restoration, and were any of those claims made in writing, such as in texts, emails, or a bill of sale?
