Based on your situation, there are several legal considerations regarding license suspensions and their impact on insurance in the United States that could potentially support your case. A license suspension, even if later reinstated, can appear on your driving record. This record is often reviewed by insurance companies when determining eligibility and rates for coverage. However, the impact of a suspension on your insurance can vary depending on the nature of the suspension and the policies of the insurance company.

Administrative suspensions, like those for failure to provide proof of insurance, are generally viewed differently than suspensions for traffic violations or criminal offenses. Insurance companies may consider the context and reason for the suspension when assessing risk.

In many cases, once a suspension is resolved and marked as "satisfied" or "reinstated," it may have a lesser impact on your insurance eligibility compared to unresolved or more serious suspensions. However, each insurance company has its own criteria for evaluating driving records.

Hello, last December while stopped in traffic someone thought it was time to go and bumped into me in a company vehicle. We reported it to the police and I provided the insurance in the company vehicle and my ID, and so did the person responsible. The sheriff told me they'd be needing my company to send in their insurance information for me. After receiving an email from the sheriff and a letter in the mail saying they need that info from my company, I sent that to my fleet manager and was told they'd take care of it. My new company just informed me that their insurance said they wouldn't cover me, so I looked at my driving record and realized my license has been suspended since December because of failure to provide insurance, which is my company's fault. They paid the reinstatement fee, but my suspension is still not lifted, and they can't get a response from their legal team on Monday about next steps to clear this off my record. Should I be thinking about court, or what should I do to get this off my record?

I understand how frustrating this situation must be for you. Have you already received any official documentation regarding your license suspension from the DMV or relevant authority?

Didn't receive an email or letter, but it is on my official driving record on the BMV website.

Have you been in contact with your company's legal team or any other legal representatives regarding this issue?

I've been in contact with my old company's fleet manager.

Yes.

Hello. My name is Richard and I have been a licensed attorney for over 25 years and hope to be of assistance. Please be advised that this website is for information purposes only and I cannot formally represent customers of this website or perform actual legal services on your behalf. I understand your license has been suspended due to a failure to provide insurance information, which was supposed to be handled by your company's fleet manager. Could you tell me more about any steps you've taken so far regarding this situation?

I had the fleet manager pay the reinstatement fee of $250, but she can't get a response from the legal team until tomorrow, so I'm not sure what next steps are needed since my license still says suspended. On the BMV website it says proof of coverage at time of accident, so I think that's all my company still needs to do.

Have you or your company been able to submit any proof of insurance to the BMV yet, or is that still pending?

I also don't know if this will be cleared from my record or it will just show I had a suspension that was lifted. And no, we have not, because they have that information, since I can't access company information anymore since I'm at a new company. I've told my old company they need to do that though.

I'd like it to be cleared since I did everything I needed to do and was not responsible for the accident.

Based on what you described, the issue is almost certainly administrative rather than something that requires a lawsuit or court action. When a crash occurs and insurance information is not verified with the state, many DMVs automatically suspend the driver's license for "failure to provide proof of insurance at the time of the accident." The suspension remains in place until two things happen: proof of insurance at the time of the accident is submitted to the DMV/BMV, and any reinstatement fee is paid.

In your situation, only the second step has been completed so far. Paying the $250 reinstatement fee alone will not lift the suspension until the state receives proof that the company vehicle was insured on the accident date.

Because the vehicle belonged to your employer, the company (or its insurer) typically must submit one of the following directly to the DMV/BMV: a certificate of insurance, or an SR-21 or similar insurance verification form confirming the vehicle was insured on the date of the crash.

Once the DMV receives that proof, the suspension is usually removed and your license status changes to valid.

As for your record: the suspension may still appear in your driving history, but it will normally show as "suspension satisfied" or "reinstated." Administrative suspensions like this generally do not carry the same weight as traffic violations because they are related to documentation, not unsafe driving.

Court action generally is not necessary for this type of suspension unless the DMV refuses to clear it after receiving valid insurance proof. In most cases the issue is resolved once the insurer or fleet manager submits the insurance verification to the state.

If the company's legal or insurance department submits the coverage verification tomorrow, the DMV usually updates the status within a few days. If the suspension still remains after the proof is submitted, then contacting the DMV's financial responsibility or compliance unit directly is typically the next step to have them manually clear the record.

Thank you for your input. Will the suspension still being on my record, even with being satisfied, affect me getting insured at my new company? Because that could be a big issue.
