Should a breach of contract claim over a reversed lease be filed before or during an eviction case?

You can file your breach of contract claim now or after the ejection case, but bringing it now does not usually delay or stop the ejection case by itself. Courts often treat the eviction or ejection proceeding as a narrow case about possession, while a contract claim about the lease may move on a separate track.

This distinction reflects the general legal principle, codified in most states' forcible entry and detainer or summary ejectment statutes, that ejection or eviction actions are limited to the question of who has the right to possess the property, and do not resolve broader contract disputes between the parties.

If you file your lawsuit at the same time, it can help preserve your claim and create a record that the landlord reversed an executed lease despite insurance being on file. Waiting is still an option, but it may give the landlord time to argue that the possession issue should be resolved first.

A practical step is to gather the signed lease, the insurance proof, and the email stating the lease was "undone," so you can present that timeline in court.

Landlord has filed ejection case, however, I also am planning to sue the landlord for breach of contract when they reversed the lease while already active. My question is: "should I wait to bring the lawsuit after the ejection case is heard, or should I bring it simultaneously if I need more time in the event that decision is not in my favor?"

I understand that dealing with an ejection case and planning to sue your landlord can be very stressful. Have you already received any court dates or notices regarding the ejection case?

Yes.

What specific breach of contract are you alleging against your landlord regarding the lease reversal?

The lease was already signed and executed by both parties when I received an email stating "the lease was undone due to no insurance policy on file." Which is a misrepresentation, there was insurance on file. They more than likely prepared the lease incorrectly, and/or needed to add additional fees that weren't charged previously.
