Excellent and very important question. If your LLC is changing from a single-member LLC to a multi-member LLC, then yes, you will need a new EIN.

A single-member LLC is treated as a disregarded entity for tax purposes. Once you add a second member, the IRS treats the LLC as a partnership by default. Because the tax classification changes, the IRS requires a new EIN.

How to Get a New EIN:

  • Apply online with the IRS — it’s free and immediate.
  • Choose “Limited Liability Company” and list two members.

Colorado is not a community property state, so adding your husband as a true co-owner requires a new EIN. The old EIN remains on record and is not canceled.
