Based on your situation, there are several legal arguments and consumer protection laws in the United States that could potentially support your case:

False Advertising: Under the Federal Trade Commission Act, 15 U.S.C. § 45, companies are prohibited from engaging in deceptive or misleading advertising practices. If the retailer’s advertisements about their delivery services are found to be misleading or false, this could be a basis for a legal claim. In California, the False Advertising Law, Cal. Bus. & Prof. Code § 17500, separately prohibits untrue or misleading advertising statements.

Breach of Contract: When you purchase items from the retailer, you enter into a contract with them. If they fail to deliver the goods as promised, or if their delivery practices consistently fall short of their advertised standards, this could be considered a breach of contract. Under California law, damages for breach of contract, Cal. Civ. Code § 3300, are the amount that compensates for the harm the breach caused.

Consumer Protection Laws: Various state laws protect consumers from unfair or deceptive business practices, such as California’s Unfair Competition Law, Cal. Bus. & Prof. Code § 17200, and the Consumers Legal Remedies Act, Cal. Civ. Code § 1770. These laws could be relevant if the retailer’s delivery practices are found to be systematically failing to meet their advertised standards.

I want to sue a major online retailer. They ensure safe and secure deliveries, but on many occasions they have not fulfilled their own company policies. I know I am not the only person affected by the cracks in their policies. I do not know if it’s the hiring managers at the facilities or if they do not have a process to audit their drivers. I do not know what the metrics are for them to ensure their drivers are honoring their company’s policy. If there is no such thing, I think there should be one. I have been stressed on several different occasions where the retailer delivers to the wrong address, or we leave instructions to call and they don’t, or they leave my package somewhere and it gets stolen, or they throw a heavy package over the gate and all my stuff breaks. It’s a lot, I apologize.

I understand how frustrating it must be to deal with these delivery issues. Have you already attempted to resolve these problems directly with the retailer’s customer service?

Yes, I have, and they always offer a refund or a redelivery. But at this point it’s getting frustrating. I ordered stuff for dinner tonight, and yes, okay, they’ll redeliver, but not today... now I have to go to the grocery store. And this is not the first time.

Are you seeking compensation for specific damages or losses incurred due to these delivery failures?

I’m seeking compensation for stress, and because the company’s policy is public and part of their advertisement. They are doing great, but they are not fulfilling what they are telling the people.

Is there anything else the lawyer should know before I connect you? Rest assured they’ll be able to help with your lawsuit against the retailer.

No.

Hi there, thank you for your question. I’m Seth, a lawyer here on our service. I understand you’re dealing with a situation where the retailer’s delivery policies have not been fulfilled, causing you stress and inconvenience.

Disclaimer: Just a note, our conversation is for general legal information only and does not establish an attorney-client relationship. Have you considered any actions or inquiries regarding this situation?

Hello Seth. No sir, this is my first time asking about it. I watch [name redacted], and the retailer frustrated me again today, so I thought about this website.

Could you tell me how long these delivery issues with the retailer have been happening? This will help us understand the timeline of events.

My girl gave birth about nine months ago, and since then we have been using the retailer’s membership service almost daily. She is a stay-at-home mother, so it’s really convenient. I would say we’ve been using the membership for nine months. I was trying to get the history of complaints or refunds, but it says they would have to email it and it might take a month. In the nine months, there have been more than 10 times where we had frustrating issues. Also, since the retailer always offers to redeliver or pay out refunds, there have been times where we did not make complaints.

Thanks for sharing that. Are there any specific instances or types of damages, beyond stress and inconvenience, that you’re seeking compensation for? This could include any financial losses or specific items that were damaged or lost.

Not really damages for products, because the retailer is really good at replacing or refunding. But what if I spent my last amount of money on the groceries that I ordered today, and the delivery driver busted open my sparkling water cans in the same package my pasta was in? Now I have soggy pasta I can’t eat, my sparkling waters are gone, and I can’t eat today. Luckily, I do have money, so I can go buy the dinner I planned to cook at the grocery store, but now it’s causing me inconvenience. The retailer’s refunds or redeliveries are not instant. I would be seeking compensation for stress and for their false advertisement of their company’s delivery policy. They advertise that they care, and even in the commercials the drivers are happy and deliver with care. Not all drivers do bad jobs, but the retailer has way too many workers. I don’t think they can even keep metrics on how their workers are doing.

Much of what you said, I thought the exact same. Also, to add to what I said about the metrics of tracking their drivers: GMPs, the retailer’s gig delivery drivers, contracted drivers, and even the retailer’s own employees have complained of being overworked several times. I have friends who have, and I’ve also seen it in articles and the news. Quantity over quality is what I’m seeing in this picture. I love that you understand exactly what I’m saying: false advertising, breach of contract, and consumer protection. It’s not a hard fix for the company, but it is a must-fix. And I wonder if it’s only because of the neighborhood I live in? Hmm, I don’t live in the nicest part of Los Angeles.

It’s understandable to feel frustrated with repeated delivery issues, especially when they disrupt your daily life. Let’s explore some potential legal avenues and steps you can take:

Document Everything: Gather emails, receipts, photos, delivery records, and all communications with the retailer’s customer service. Detailed documentation can strengthen any potential claim.

Review the Retailer’s Policies: Compare the retailer’s delivery and customer service policies with what actually occurred to identify possible breaches or misleading representations.

Consider Small Claims Court: Small claims court may be an option for seeking compensation for damages or losses without needing an attorney. Check your local court’s filing limits and procedures.

Explore Alternative Dispute Resolution: Mediation or arbitration may provide a faster and less expensive way to resolve the dispute before filing suit.

Raise Awareness: Posting reviews or sharing your experience on consumer platforms or social media may encourage a response and help inform other consumers.
