Hello! My husband and I are planning to file for an uncontested divorce. We have no children and have already divided our assets, debt, etc. We are in agreement on all things and want a quick, easy divorce. We live in Arkansas. I’m very confused by a lot of the legal lingo about what is required to submit to the courts. I want to make sure I’m not missing anything.

Below is what the document states: “XII. HUSBAND’S PROPERTY. It is declared by the Couple that, under this Agreement, the Husband shall be the owner of the following: Only item is $200K payout from home refinancing, which will happen prior to divorce. This is a one-time cash out, and he will not pursue any other financial assets after the $200K cash out.” Does this verbiage suffice?

I have had a preliminary consultation with a divorce attorney. The retaining cost is $4,000 which is a bit steep currently. I decided to file the preliminary paperwork myself as a result. If, in fact an attorney is needed further into the process I plan to certainly secure that service. My husband was diagnosed with dementia last October and his needs far outweigh what I am reasonably able to provide. During consult with the attorney, she mentioned that the state may mandate a representing advocate husband due to his diagnosis. Is this the case? Additionally, my children sold the home to us with $60,000 equity for my sake to be close to the grands. Can this be considered? I have not filed yet.

They have not signed any agreement. They are both in their 80s and have been married about 6 1/2 years. She moved back home to TN for health reasons, and he does not want to move with her. Basically, I believe she will keep what was hers and he will keep what was his. No minor children. No major assets. She does have some savings and stock that she had going into the marriage. We are not sure what debts he has. She has no debts.

I am just looking to file for divorce. My wife had a major stroke 5 years ago. We had agreed to divorce before her accident. I stayed to take care of her. I want to just get the filing in to start the process. I plan on selling our home with most of the equity going toward her care. Until that time comes, I will continue to take care of her until her family and I make arrangements for where she will be going. Can I file before then?
