[AR] How do I file for an uncontested divorce?

AR Divorce

Hello! My husband and I are planning to file for an uncontested divorce. We have no children and have already divided our assets, debt, etc. We are in agreement on all things and want a quick, easy divorce. We live in Arkansas. I’m very confused by a lot of the legal lingo about what is required to submit to the courts. I want to make sure I’m not missing anything.

Since you're in Arkansas and pursuing an uncontested divorce with no children and everything already divided, the process is straightforward but the paperwork can feel overwhelming. Here’s what you typically need:

  • Residency requirement (60 days before filing / 3 months before final decree) (Ark. Code Ann. § 9-12-307(a)(1))
  • Grounds for divorce (“general indignities”) (§ 9-12-301(b)(3))
  • File initial documents: Complaint for Divorce, Summons, Cover Sheet
  • Spouse signs Entry of Appearance & Waiver of Service
  • Property Settlement Agreement detailing your division of assets/debts
  • Short final hearing with a witness confirming residency/separation
  • Final Decree of Divorce signed by the judge

Some counties offer self-help packets with fill-in forms. If needed, you can contact the local bar association, legal aid, or a law school clinic for help.

I understand that navigating the legal process for an uncontested divorce can be overwhelming. Have you already started gathering the necessary documents required by the court in Arkansas?

Yes, somewhat.

Are there any specific terms or legal jargon that you find particularly confusing?
