If both parents agree to a temporary deviation from the order and it doesn’t harm the child or the other parent’s rights, accepting extra time generally isn’t contempt (R.C. 3119.22–.23). Get the other parent’s consent in writing. Don’t unilaterally extend time without consent. This doesn’t modify the existing order—future visits still follow the order unless you both agree again (R.C. 3109.04(E)). Proof of her consent helps if contempt is later alleged.

She often goes back on her word and lies to the court. I’m trying to play it safe, but she had our child call my mother crying because I won’t allow a visit before she flies back to Florida.

Do you have any follow-up questions?

How do I admit exhibits at a child support hearing, and get the magistrate to consider that she claimed “significant hardship” without proof? I sent three discovery requests for proof and got only objections.

I can’t give advice on how to admit exhibits; I can only answer general legal questions.

Thanks.
