I'm not sure about the form number. It says “Texas Marital Settlement Agreement.” I’m in Irving, Texas, but my driver's license is from Florida. I’ve been here for over three years.

A marital separation agreement, or property settlement agreement, is a written contract that divides property and spells out rights and responsibilities, such as alimony and custody (Texas Family Code § 7.006).

You don’t usually need to file it with the court for it to be effective. But once both parties sign it, it can be filed with the clerk in your local district court’s family law section. The court will review it, and if it is approved, it’ll become part of the final divorce decree.

It is not necessary at this point to file a birth certificate or lease agreement. If/when you file your petition for divorce, those items may be required. For now, if you plan to file, you’ll need to physically go to the court and file the agreement with the clerk.

I haven’t filed the petition for divorce. I thought it was enough (and faster) with just the settlement.
