Texas. Are you a real human? I need to customize the spousal support portion first. I want to know if it can set a minimum, but if the current income supports, then I receive more. I have been a stay-at-home parent for 20 years. The agreement is to be half of all income. This includes salary, OT, equity, bonus, rental, and any other forms of income.

He has a disability policy for additional coverage in case of disability, and I need verbiage that includes half of that in case he is unable to work.

Next issue is if either party takes on debt on their own, they are responsible for the debt, not both spouses.

All assets to be split in half in divorce, and return of all sole and separate money funds returned to me.

The spousal support piece with a minimum floor that adjusts upward based on actual income is workable. You'd structure it so there's a guaranteed minimum, but if his income exceeds a certain threshold, you get a percentage of that excess. That protects you if income fluctuates while also incentivizing transparency about what he actually earns.

The disability policy language is important. You'll want to specify that any disability benefits he receives count as income for purposes of the spousal support calculation, and that you're entitled to half of those payments. This closes a potential loophole where he could claim lower income while collecting disability.

The separate debt provision is standard, and Texas courts generally respect those. Each party takes responsibility for debts incurred in their own name. Just make sure it's clear whether this applies to debts incurred before or after the agreement, or both.

The disability was through an employer, but I believe he can take it from job to job now that he has it. I can confirm more if it would be helpful. He is still at the job that had it as an option. Also, I want that all current life insurance policies stay for either my benefit or that of our mutual children.

Also, basically all of our assets are community assets at this point. We have been married since 2004. We didn't have much before that. So I am just wondering how I modify the actual form to reflect all of this.
