Hello, I created a mutual (non-contested) marital settlement agreement for a divorce. My spouse is living in another country. Does she need to have it notarized in another country, or do I notarize it in the United States?

I understand the importance of ensuring your marital settlement agreement is properly notarized. Have you and your spouse already signed the agreement?

Not yet. I need to send it to her because she is living in another country.

In which country is your spouse currently residing?

Colombia.

Is there anything else the Family Lawyer should know before I connect you? Rest assured they'll be able to help with notarizing your marital settlement agreement for Colombia.

Yes, she is willing to sign it and we have agreed upon signing a post-nuptial agreement also. Does that need to be notarized also?

Hi and welcome to AskaLawyer. Ray here to help you today. I understand you're navigating the notarization process for your marital settlement agreement and post-nuptial agreement.

Yes.

Ray

She would need to have it notarized where she lives, and you need the agreement signed and notarized here as well. Both the post-nuptial agreement and marital settlement agreement have to be notarized by a U.S. notary. She can do this at the U.S. Embassy if she is overseas.

She would need to fly to the capital in Bogota.

Can she do it with a local notary, or does it have to be done at the embassy?

Ray

No way around it unless she is returning to the U.S. She would have to fly there—it must be a U.S. notary.

Understood. She will have to do it that way. She entered the USA irregularly and self-deported to avoid issues with immigration. She cannot return via plane to the USA.
