Here's a structured approach to help you navigate your workers' compensation insurance issue:

  1. Contact Your Insurance Provider: Reach out to your insurance provider immediately to discuss the urgency of obtaining the Delaware endorsement. Explain the potential impact on your contract and request expedited processing. If possible, speak directly with a supervisor or someone in a decision-making position. Under 19 Del. C. § 2371(b), an employer whose primary place of business is in another state can meet Delaware's requirement with an actual Delaware workers' compensation policy, a written rider on an out-of-state policy that covers the work as fully as a Delaware policy would, or a valid declaration of self-insurance.
  2. Explore Alternative Insurance Options: If your current provider cannot meet your needs in time, consider contacting other insurance companies that specialize in multi-state workers' compensation policies. Some providers may offer faster solutions or temporary coverage options.
  3. Communicate with the Attorney General: Keep the Attorney General's office informed about your efforts to obtain the endorsement. Provide them with any documentation or correspondence that shows your proactive steps. This transparency can demonstrate your commitment to resolving the issue. Delaware requires employers to file evidence of their insurance compliance with the Department of Labor under 19 Del. C. § 2374, so the endorsement or rider will ultimately be the document that resolves this.
  4. Consider Settlement Options: Since you mentioned the possibility of a settlement with the former employee, ensure that any agreement is documented and legally binding. This can help mitigate potential legal risks while you address the insurance issue.
  5. Prepare for the Motion to Vacate: While working on the insurance endorsement, continue preparing for the motion to vacate the default judgment. Gather any evidence or documentation that supports your case, and be ready to present it during the review.

Right now, I have an issue with an employee who has filed through the Department of Labor for a fake injury. At the time of the incident, I did not have workers' comp insurance. However, I just obtained workers' comp insurance and was told that it would cover all states. My home state is Georgia. However, this issue is in the state of Delaware. I was told by the state of Delaware that it needs to be exclusively stated on the workers' comp policy or it is invalid. Right now I'm having a hard time getting that endorsement, and I am under a significant time crunch to get a valid endorsement for Delaware comp insurance. Is there any type of buffer, cushion, or alternative I can use, with me being out of state, with me being a veteran, or anything that can help, because I am a multi-state government contractor?

I understand how stressful it can be to navigate workers' compensation issues, especially with the added pressure of a time crunch. Can you tell me if you have already communicated with your insurance provider about the specific endorsement needed for Delaware?

Have you received any formal communication from the Department of Labor regarding the employee's claim that you need to address?

Is there anything else the Employment Lawyer should know before I connect you? Rest assured they'll be able to help with your workers' comp issue.

Yes, I have a default judgment and I submitted a motion to vacate. That will be reviewed in a couple of weeks.

Yes, I intend on paying the fees and offering the former employee a settlement. However, the biggest issue is the insurance. I need that endorsement immediately or it puts my current contract at risk.

Thanks for sharing that. Have you had any communication with the Department of Labor regarding the default judgment and your motion to vacate? If so, what was discussed?

The motion to vacate will be reviewed in a couple of weeks. I've been in communication with the attorney general. They are asking for the endorsement.

Based on your situation, there are several legal arguments and considerations in workers' compensation law that could potentially support your case:

Workers' Compensation Coverage: Generally, employers are required to have workers' compensation insurance to cover employees in case of work-related injuries. The requirement for coverage can vary by state, and in your case, Delaware requires specific endorsements for out-of-state employers.

Default Judgment: A default judgment occurs when one party fails to respond to a legal action, resulting in a decision in favor of the other party. Your motion to vacate is an attempt to overturn this judgment, which can be granted if you can show a valid reason for not responding initially.

Interstate Insurance Requirements: As a multi-state contractor, you may face different insurance requirements in each state where you operate. Delaware's requirement for a specific endorsement highlights the importance of ensuring compliance with local laws to avoid legal and financial risks.
