Based on your situation, there are several legal arguments and employment laws in California that could potentially support your case:

Retaliation: Under California law, it's illegal for an employer to retaliate against an employee for engaging in protected activities, such as filing a complaint about workplace issues (see California Government Code § 12940(h), and, for complaints reporting a suspected violation of law, California Labor Code § 1102.5). If your PIP and subsequent termination were in response to your complaint, this could be considered retaliation.

Wrongful Termination: California is an at-will employment state (California Labor Code § 2922), but there are exceptions. Termination based on discrimination or retaliation for protected activities can be grounds for a wrongful termination claim.

Discrimination: If your termination was influenced by your gender, ethnicity, or medical condition, it could be a violation of California's Fair Employment and Housing Act (FEHA), which prohibits discrimination based on these factors (protected categories, including age 40 and over, are defined in California Government Code § 12926).

Severance Negotiation: While not legally required, severance agreements can be negotiated, especially if there are potential claims of wrongful termination or retaliation (California also limits certain confidentiality and non-disparagement terms in separation agreements and requires notice of the right to consult an attorney; see California Government Code § 12964.5).

How much is a retaliation PIP termination claim worth?

Hello. My name is Richard and I have been a licensed attorney for over 25 years and hope to be of assistance. Please be advised that this website is for information purposes only and I cannot formally represent customers of this website or perform actual legal services on your behalf. I understand you're dealing with issues related to personnel files and a retaliation PIP termination claim. Could you tell me more about any steps you've considered taking regarding this situation?

Hi Richard, thank you! Yes. I received a bonus last summer. Then I raised an issue/complaint with the Director of Tax Operations. Soon after, I was put on a PIP with no negative feedback having been received previously. Throughout the PIP term, zero performance feedback was provided, and they kept promising me the feedback would be available after the PIP term was over. Well, during this meeting, I was just told I failed the PIP and I am being terminated. I just need help in negotiating the severance agreement. Additional facts: I am a 43-year-old female of Turkish descent. Also, throughout the term of the PIP I endured a serious medical condition, which completely went away when I got terminated. I had to go through a ton of diagnostic appointments and ultrasounds. I am still on the hook for some of these medical bills (perhaps the former employer can help me with this).

California.

Thanks for sharing that. Have you received any written communication or documents from your employer regarding the PIP or your termination? This could include emails, letters, or the severance agreement itself.

Yes.

I have quite a bit.

And contemporaneous notes I made in my journal.

Here's how you can approach negotiating your severance agreement:

  1. Review the Severance Agreement: Carefully read through the severance agreement you received. Look for any clauses related to non-compete agreements, confidentiality, and any waivers of rights. Make sure you understand what you're agreeing to before signing anything.
  2. Identify Your Leverage: Consider any potential claims you might have against your employer, such as retaliation or discrimination, as these can be used as leverage in negotiations. Your medical condition and the lack of feedback during the PIP could also be relevant.
  3. Calculate Your Needs: Determine what you need from the severance package. This could include additional pay, extended health benefits, or assistance with medical bills. Be clear about your priorities.
  4. Draft a Counteroffer: Prepare a counteroffer that outlines your requests. Be reasonable but firm in what you're asking for. Highlight any legal claims you might have as a basis for your requests.
  5. Negotiate: Approach the negotiation with a collaborative mindset. Be open to compromise, but also be prepared to stand your ground on key issues. It's often helpful to have a lawyer review your counteroffer and provide advice.
  6. Consider Legal Assistance: Given the complexity of employment law and the potential claims involved, consulting with an employment attorney can be beneficial. They can help you understand your rights and negotiate more effectively.

Thank you, Richard. Can you please provide a template for a counteroffer that I may use? Additionally, can you provide more detailed advice on calculating the counteroffer dollar amount in light of the retaliation claims?

Ok, thank you. Is there a California employment attorney you might be able to recommend?
