It sounds like you need to update the certificate of trust to reflect your new role as the sole trustee.

  1. First, you'll want to ensure that the amendment is properly documented and signed by the grantor. (Va. Code § 64.2-729 —  (Uniform Trust Code §602)) Do you have a copy of this amendment ready? If so,
  2. The next step would be to contact the institution or entity that issued the original certificate of trust to request an updated version. They may require you to provide a copy of the amendment and possibly other documentation. You can also draft your own online.
  3. When drafting the certificate of trust, it's important to reference the amendment to ensure clarity about your role as trustee. You can include a statement like:

“This Certificate of Trust acknowledges that [Your Name] has been appointed as the trustee of the [Name of Trust] as per the amendment dated [Date of Amendment], signed by the grantor, [Grantor's Name].”

Make sure to attach or reference the amendment document itself for complete transparency.

I need a certificate of trust which was amended of the creation date. The amendment signed by the grantor appoints myself as trustee. I was co-trustee during the grantor's life but now has passed and I'm the trustee.

Do I address the amendment in the certification and if so, what is the language?

I understand that obtaining a certificate of trust can be important for your needs. Can you please confirm if the trust is currently active and in good standing?

Yes and in good standing.

Have you already contacted the trustee or the institution that holds the trust regarding this amendment?

I'm the trustee — the change in the amendment is changing the trustee from the original document.

The original document has an amendment changing the original trustee.

Could you tell me more about the specific changes made in the amendment? Are there any particular concerns or requirements you have regarding this change?

I am in the process of drafting myself. I do have a signed amendment by the grantor appointing me as trustee. There is no original certificate; this will be the original upon completion.
