I'm really sorry to hear about your husband’s situation; it must be incredibly challenging for you. Have you already discussed hospice care options with the medical team at MD Anderson?

Yes, I have. I thought I had a power of attorney, but it’s actually a medical power of attorney. So I need to make sure I’ll be able to make financial decisions for him.

Have you considered any legal documents like a durable power of attorney or an advance healthcare directive?

I just filled out the form for a durable power of attorney. I need to get it notarized, right?

Is there anything else the lawyer should know before connecting you?

No.

Benjamin

Hello, my name is Benjamin, and I’ve been a licensed attorney for over 19 years. Has your husband filled out the durable POA form, or did you fill it out? Is he capable of granting you a POA, or is he incapacitated?

He’s capable. We just filled out the form.

Benjamin

He needs to sign a durable power of attorney in front of a notary. There are traveling notaries who can come to the hospital (Uniform Law on Notarial Acts (ULONA / RULONA)).

I just want to make sure there’s nothing else I need to do. I’m assuming I have to have it notarized?

Benjamin

Yes, that will complete it.

Ok perfect. Thank you.

Benjamin
