If your grandmother understands, then a durable power of attorney is an option. If you wanted guardianship, that would have to be filed through the probate court, and it requires that your grandmother lack competency.

A power of attorney can allow you to make decisions on her behalf. It would allow any powers listed in the power of attorney document. (NC Gen Stat § 32C-1-109)

My grandmother is 99, and her son (my father) is her only living child. We are both on her bank account as signers. We need legal guardianship over her person and property. Is a dual power of attorney the correct form?
