Solved

As a named beneficiary in the will, Texas law (TX Est Code § 308.002) requires the executor to notify you within 60 days after the court admitted the will to probate on May 6, 2025. You were entitled to that notice since your identity was known. Community property you owned jointly cannot be taken by the executor without your consent. List the specific items she took and check for receipts or statements showing joint ownership to protect your rights.

Hi. I have a question. My husband died on 7-18-2024 in Texas. I just found out his will was probated and signed on 5-6-2025. I was not notified about this. Shouldn't I have been notified?

I'm so sorry to hear about your husband's passing and the confusion surrounding his will. Were you listed as a beneficiary in his will?

It was a pretty generic will. Only myself and his daughter were named in it. He had made her the executor.

Have you had any communication with the executor of the estate regarding the probate process?

No. She started taking things from me as soon as the coroner wheeled him out of the house. Then less than 2 weeks later came over and told me to pack my things and that she was taking me to my son's. I was still in shock when all this happened. He left her his personal property, but she took over $100,000 worth of community property.

Is there anything else the lawyer should know before I connect you? Rest assured they'll be able to help with your probate issue.

No.
