How do I get my passport back after it was confiscated by USCIS?

I’ve been getting the run around. I’m trying to get a passport from the Zimbabwe embassy. I had my passport confiscated at the Border Patrol in Buffalo, NY. I was supposed to receive it after my case was dismissed at the US immigration court office in San Antonio.

I won my case. But I never received it after the case. They told me they sent it back to immigration. And now the Zim embassy is telling me I need a police report because it’s lost. But I can’t seem to get any answers from anyone.

I just need to see if there’s a way I can get a police report so I can go back to the embassy before they close today. I have to go back to Dallas today.

You can file a Form G-884 with USCIS to request the return of your passport. You can find the form and instructions here: https://www.uscis.gov/g-884

I understand how frustrating it must be to deal with this situation regarding your passport. Have you already contacted the local police department to inquire about obtaining a police report for your lost passport?

Yes I have.

Have you received any written communication from the Zimbabwe embassy or the immigration office regarding the status of your passport?

No. It was over the phone. I was confiscated by Border Patrol office in Buffalo and they sent it to San Antonio and told me to contact San Antonio office.

Is there anything else the immigration lawyer should know before I connect you? Rest assured they’ll be able to help with your passport issue.

Yes.

How are you today? Have you tried reporting your passport as lost to the local police?

Yes I have. I’m in Washington DC and they told me because it wasn’t lost here, I can’t file it here.

I’m okay, by the way. Despite this frustrating process.

I’m glad you’re doing well!

Can’t file.

Have you tried contacting the police in Buffalo, NY or San Antonio? Your other option is to try to get the passport back from the U.S. government. What is your understanding of which agency currently has the passport? Is it ICE or USCIS?

No. And that’s the issue. I’m not sure where the passport was lost. And when I contacted both offices they sent me back and forth.

USCIS.

You're welcome. Do you have any other questions about this for now?

Well, I just wanted to see if there was a way I could get a police report. And it’s frustrating because when I’ve tried to get my embassy to help me retrieve it, I’ve never gotten a response.

I will figure it out. Or if not, I’ll just have to wait till I’m eligible for US Citizenship. Thank you.

I would think Buffalo, NY might be the correct place for the police report. The theory would be that that is where the passport was taken from you, and you never got it back. But the “correct” process here is to file the G-884 to request your passport be returned. You could also consider contacting your U.S. senator or congressperson for assistance.

I live in Texas. So I’d contact the US Senator?

Yes, you could contact your U.S. senator or U.S. representative’s office.

You should be able to find information on their website about how to request assistance with a federal agency.

Ok.
