With a cease and desist, it just has to be clear you will pursue legal action if they do not stop their actions. Sending it via certified mail is usually the next step.

I understand how frustrating it can be to deal with online posts that may harm your interests. Can you tell me what specific content in the post you want to address in the cease and desist letter?

It was a post that included the homeowner's information that was poorly redacted, the information that the woman was 41 but was not. He stated he was with the family when he wasn't and that the family had been notified.

Have you already attempted to contact the individual or entity responsible for the post before considering a formal letter?

Yes.

Is there anything else the Lawyer should know before I connect you? Rest assured they'll be able to help with your cease and desist letter.

It's my sister-in-law and she died and her children had not even been notified yet.

Hi there! My name is Liz and I’ve been an attorney for more than a decade, and I am here to assist with your legal concerns. So I can best help, when was the post posted?

The day she passed, right after he heard it on the scanner. He's a person that sits at the scanner and posts “news.” He posted about her and the Beacon (parcel information) of their address and poorly blocked out my brother-in-law's name.

I'm so sorry for your loss. Does he leave the posts up?

Yes, he does. He then goes on to be extremely rude and nasty in the post and claims that he was there (he was not), that all the family had been notified (they weren't—her daughter still did not know), that he was talking to her sister (he was not), and that they were going out of state to notify family (her family is here). I asked him to take the posts down and he got really nasty with me and told me, in a not so nice way, to kick rocks and left me his attorney's information. I called the attorney and they can't verify he is a client.

We live in Indiana.

I'm so sorry again. That had to be rather traumatizing for him to be posting things that are untrue.

I filled one out and put “other” and listed what he did. Should I hire an attorney first or start with the letter and go from there?

Gotcha, thank you so much. I really appreciate your help!
