Based on your situation, there are several legal arguments and considerations in small claims court that could potentially support your case:

  1. Verbal Agreements: While verbal agreements can be legally binding, they are often harder to prove in court compared to written agreements. Under the Texas statute of frauds, only certain types of agreements must be in writing to be enforceable, such as agreements that cannot be performed within one year, so a short-term verbal arrangement between roommates is not automatically unenforceable just because it was never written down. The fact that you had a verbal agreement to pay rent until the end of the lease may be challenged if there is no written documentation to support it. (TX Bus & Com Code § 26.01)
  2. Lease Agreements: Since there were two leases for the property, one with your ex-girlfriend solely and another with you and the other roommates, the court may consider the terms of these leases separately. Your obligations might be tied to the lease you signed with the roommates. Keep in mind that in Texas, a tenant may not rent the leasehold to anyone else during the lease term without the landlord's prior consent under (TX Prop § 91.005), so any sublease or replacement tenant would generally need landlord approval.
  3. Notice of Termination: Your text message on December 31st notifying your ex-girlfriend that you would no longer be paying rent could be seen as a notice of termination of your verbal agreement. However, the timing and manner of this notice might be scrutinized to determine if it was reasonable and in accordance with any implied terms of your agreement.
  4. Shared Responsibilities: The fact that you were handling the electricity bill and sought to transfer this responsibility could demonstrate your willingness to fulfill your obligations until you formally ended your involvement.

Hello. My name is Richard and I have been a licensed attorney for over 25 years and hope to be of assistance. I understand you're being taken to small claims court by your prior roommates for $2000 in damages for unpaid rent. Could you tell me more about any written communication or agreements you've had with them regarding this claim? Disclaimer: Just a note - this conversation does not create an attorney-client relationship. I can answer your questions for educational purposes only.

On august 28 I moved out but continued to pay rent until the end of December. I made a verbal agreement on the 28 that i would pay rent until the end of the lease but i did not want to keep doing that since i had fully moved out and notified my ex girlfriend December 31st I would no longer be paying rent.

I've had no more communications other than the text I sent on December 31st about this case.

Richard

Richard

Thanks for sharing that information. Did you have any written communication, like emails or texts, with your ex-girlfriend or roommates about the rent agreement or your decision to stop paying? This could help support your case.

There was only one text sent on December 31st from me to my ex girlfriend informing her I would no longer be paying rent. In a group chat I did ask that since the electricity bill was in my name I would hand that over to another roommate so I did not have to handle paying that bill anymore.

Richard

Richard

Got it, thanks for clarifying. Was there a written lease agreement for the apartment, and if so, were you and your roommates all listed on it? Or was the agreement purely verbal?

Yes there was a written lease but it was two leases for the same property, one had my girlfriend solely on it and then the one I had sent to me had myself and the three other roommates living with us. And my lease does not make a mention of her lease.

Can i send my main points from my counter claim so we can go over if my counter claim has any merit?

I did sign a lease from June 2024 to June 2026 the verbal agreement was just made for the last 7 months of the lease just to clarify. But that verbal agreement was just with my ex girlfriend not with the landlord's.

I understand your situation better now. However, I'm more than happy to continue discussing general legal information and guidance to help you navigate your situation. Please let me know if you have any follow up questions?

One of my first claims I made is that after I contacted my landlords to ask about subleasing and my girlfriend came back and said I had no way to sublease since a new tenant would be sleeping in her/our room. I believe she spoke to the landlords and told them they did not need to look for a new tenant and that I instead would seek a subleasee but she would not permit any replacement tenant for landlord approval because of the sleeping arrangement that would ensue.

I believe one claim I can make is her refusal to cooperate with reasonable mitigation efforts.

Richard

Richard

That's a valid point to consider. If your ex-girlfriend's actions prevented you from subleasing or mitigating your financial obligations, it could be a strong argument in your counterclaim.

Could i claim unjust enrichment because of the 4 months i paid rent while she was not cooperating with reasonable mitigation efforts?

Richard

Richard

No.

Even if she was blocking subleasing opportunities?

Richard

Richard

It's not an unjust enrichment claim.

Is there any thing I can make a point of in court that my girlfriend filed this claim against me while the lease was active? I have a date set for July 23 which is after the lease has ended but for any claim involving payment of rent wouldn't the landlord have to file against me.

Richard

Richard

You can certainly bring up the point that the lease was still active when the claim was filed. This might affect the court's view on whether the claim was premature. Regarding who should file the claim, typically, the landlord would pursue unpaid rent claims.

but even if the claim was premature can she still go after damages for the rent she paid on my behalf by filing a new claim

Richard

Richard

If your ex-girlfriend paid rent on your behalf, she might attempt to file a new claim for reimbursement. However, her success would depend on the specifics of your agreement and any evidence she can provide. I hope I was able to help resolve your issue! If you have any other questions, feel free to ask. Don't hesitate to reach out whenever you need assistance!

What evidence would she have to have to validate that new claim?

Richard

Richard

For your ex-girlfriend to validate a new claim for reimbursement, she would likely need to provide evidence such as:

  • Proof of payment for the rent she covered on your behalf, like bank statements or receipts.
  • Any written communication or agreements between you two regarding her covering the rent.
  • Evidence that she attempted to mitigate the situation, such as trying to find a subtenant.

How does it change the situation if the court does deem the terms of our two leases separately? Would my obligation/damages owed be higher since it would be a monthly rent of 2500 split between 4 people instead of 5? Even after they've already claimed they're looking for 2000 in damages?

Richard

Richard

If the court views the leases separately, it could potentially affect your financial obligations. If your lease is considered independently, your share of the rent might be calculated based on the number of people on your lease, rather than the total number of occupants. This could mean a higher individual obligation if fewer people are responsible for the rent. However, since they are claiming $2000 in damages, the court will likely focus on the evidence and arguments presented to determine the appropriate amount.

Now that a date has been set I assume I need to gather my evidence. Do I need to have paper copies and submit to the Texas efile system anything i deem as worthy evidence? I don't know in how the court proceeding will take place, will there a be discovery? Should i have evidence ready to show to a mediator?

Richard

Richard

Unfortunately. I cannot give direct legal advice on this website a to how to file legal documents. You would need to contact the clerk of court for assistance.

Okay but in what steps does a small claims court proceeding take place?

Richard

Richard

Each county and state is different. I would recommend contacting your local clerk of court for guidance.

I'm in [redacted: city and county], Texas. Can you elaborate any further with that information?

Richard

Richard

No, I am not in that county. Your local clerk of court can give more guidance.

Can you give me an example of how proceedings take place in your county so I can have an idea of what to expect?

Richard

Richard

Each county is different so it would not be applicable to your county. Again, your local clerk of court can give you a more detailed guidance on what your particular county does for proceedings.

Yes but at times my county clerk has proven hard to get ahold of so I'd be curios to know how another county does it just to gain rudimentary understanding of how my proceeding might happen.

Richard

Richard

Small claims court is primarily for pro se plaintiffs. As a result, I do not practice in small claims court and do not know what the process is. Generally my understanding is you have a pre trial hearing, mediation and then trial.

Since I was sharing a room and my girlfriend admitted to the subleasee not being a viable option in their original claim, can I make a point that they cannot invoke joint and several liability portion of the lease because they admitted to me being confined to a portion of the home implying an unequal distribution of the property to me. Maybe warranting a lesser amount due in damages?

Richard

Richard

I have signed off for the evening. Feel free to reach out if you need further assistance.
