The Social Security Administration (SSA) follows federal name-change rules, and those rules are stricter than Minnesota or U.S. passport standards. Even though your name was legally changed in Australia and your passport reflects it, SSA does not automatically accept foreign name-change documents.

Under SSA regulations, a foreign name-change certificate is only acceptable if it is treated as the equivalent of a U.S. court order. Many Australian name-change certificates are issued through the Births, Deaths & Marriages Registry, which is valid abroad, but SSA often rejects them unless they include specific authentication.

The most common reason for rejection is that the document does not include an apostille from the Australian Department of Foreign Affairs and Trade (DFAT). SSA requires foreign civil documents to have an apostille to verify authenticity. They may also require a certified English translation, even if the document is already in English, because their internal rules require translator certification. Without those components, SSA will not process the name change.

You have two options:

  1. Re-submit your Australian name-change certificate with:
    • A DFAT apostille
    • A certified English translation
    • Your Australian passport showing your updated name
    • When submitted together, SSA is required to accept them unless fraud is suspected.
  2. File a simple name-change petition in Minnesota. Once a Minnesota court issues its own name-change order, SSA must accept it without apostille or translation requirements. (MN Stat § 259.10)

I need to clarify — my new name is on my U.S. passport also. I have below appointment booked through DFAT but I’m worried it won’t be enough.

Yes, your Australian passport and U.S. passport both showing your new name are strong proof. However, SSA still requires your Australian name-change certificate to have a DFAT apostille before they update your record.

The appointment you booked with DFAT is the correct service. Once they attach the apostille, SSA must legally accept it.

When you go to SSA, bring:
• Your Australian name-change certificate
• The DFAT apostille
• Your U.S. passport with your new name

With those documents, they cannot refuse your name change.

The Warren E. Burger Federal Building is not the correct place. Federal courts do not handle name-change proceedings.

You must file in the Minnesota District Court for the county where you live.
