It sounds like you're on the right track with the "Petition for Change of Name of Minor" form. If you're unable to find it online, you might want to check the official website of the Arkansas court system or contact the court clerk in Union County for guidance on obtaining the correct form. (AR Code § 9-2-101)

In cases where one parent is deceased, you typically need to provide a copy of the death certificate along with your petition. This will serve as proof that the other parent's consent is not required. (AR Code § 20-18-305)

If you're unsure, it's always a good idea to check with the court clerk to confirm their specific requirements.

Arkansas Petition for Name Change - Minor

Full Conversation

I am trying to fill out forms to request name changes for myself and my 4 children. I have one child who is still a minor and I'm not sure what I need to submit a petition for name change for him. His father passed away due to cancer in 2024, so I don't have a parent that will need to consent to the change other than myself.

I'm sorry to hear about your loss; that must be a difficult situation for you. Can you tell me which state you are in, as name change laws can vary?

Arkansas in Union County.

Have you already started filling out the forms for the name changes, or are you looking for guidance on where to begin?

I filled out the forms back in May. I cannot remember what was done. I submitted them to the court and was told I need to also submit copies of ID cards and Social Security cards. They told me I would need to fill out all the forms again though.

Hey there! I'm Andres Sanchez, an attorney with many years of experience.

I understand you're dealing with a situation involving name changes for yourself and your children in Arkansas, and you need guidance on submitting a petition for your minor child. Could you share more about any specific concerns or questions you have regarding this situation?

I had filed documents with the court several weeks ago. They called me and told me it was pending the submission of copies of ID cards and SS cards. The clerks told me I need to do all the paperwork again that I had previously filed. I just cannot remember what form I used for my minor son. I am trying to locate the correct form to do a petition of name change for a minor. My husband passed from cancer in 2024, so I am the only parent that would need to give consent to the name change. We are in Arkansas.

Let's start by identifying the correct form for a minor's name change in Arkansas. Typically, you would need a "Petition for Change of Name of Minor" form. Since you've already submitted documents before, it might be helpful to check if this was the form you used.

Could you confirm if this sounds familiar, or if you have any other details about the forms you previously submitted?

I was looking at my saved documents on this site and only found the documents for me and my other children over 20. That form sounds correct, I just can't find it in a search on the site either.

I remember that the document had a page for the father to consent to the name change. Since he is deceased, do I just leave that page out or do I need to do anything special?
