[TX] How do I remove my previous partner's name from the deed of my property?

Hi, I'm currently filling out a Texas quitclaim deed to remove my previous partner's name from the deed. I think I’ve done it correctly, but I’ve never done this before and want to make sure it’s accurate before I take it to the county clerk.

Hi, I'm currently filling out a Texas quitclaim deed to remove my previous partner's name from the deed. I think I’ve done it correctly, but I’ve never done this before and want to make sure it’s accurate before I take it to the county clerk.

I understand the importance of ensuring accuracy. Have you reviewed the deed with a real estate lawyer or legal professional?

I have not.

Have you double-checked all the information on the deed, including the legal description and the names?

Yes ma’am, I have.

Is there anything else I should know before we proceed?

Nothing I can think of. I'm trying to learn as I go. I’m pretty new to this.

Thank you for the information. I’m Jessica, a licensed attorney. I’ll be helping you with your question shortly. You might see a prompt for a phone consultation—that’s optional. Does your former partner consent to signing the quitclaim deed?

Yes.

Jessica B

Great. Are you able to upload the deed for my review?

Yes ma’am, give me one second please.

Jessica B

Your previous partner is the grantor, and you are the grantee. Since she is transferring ownership, only she has to sign the deed. Make sure she signs it in the presence of a notary (Texas Property Code § 12.001(b)). Then, take it to the clerk in your county to record it.

Oh, I understand. Ok, perfect, so she’ll sign in front of the notary. Thank you so much for all your help, Jessica. You’ve been a lifesaver.
