[TX] How do I get my birth certificate corrected with a new name?

I am wanting to have my birth certificate corrected. My mother changed my name on Dec 23, 1976 to my stepfather and rapist of 10+ years. I want it corrected and I am wondering if I have to request a new name change or will an affidavit work.

I'm sorry to hear about your situation. Do you have any legal documentation or evidence related to the name change and the circumstances surrounding it?

Yes.

Is there anything else the Family Lawyer should know before I connect you? Rest assured they'll be able to help with your name correction.

No.

You would have to file a petition for a name change to legally change it. Once granted by the judge, it is submitted to the Bureau of Vital Statistics, and you get an amended birth certificate. But this is the only legal way to change your name here as an adult. It is pretty simple; you file with the District Clerk in your county courthouse, and the judge will set it for a hearing.

You can access Name Change Forms for eFiling here.

Filing a Petition for Name Change in Texas:

  1. File a petition and other required forms
  2. Submit a fingerprint card and supporting documents
  3. Pay the application fee (or file an inability-to-pay form)
  4. Attend a virtual or in-person court hearing (depending on the county)

See the Forms section for a sample name change petition form. If you have questions about the filing process, contact your district clerk's office.

Thank you so much.
