A trust certificate means nothing legally at this point because you do not have a trust yet. You are essentially going in a reverse order. You have to set up your trust first. Then you can transfer assets into the trust by retitling them.

With real estate, you have to have a brand new deed prepared from you personally over to the trust, sign the new deed in front of a notary public, and record it at the local Land Records Office.

With bank accounts, you have to go to your bank with a copy of your executed trust documents and transfer the accounts into the trust by retitling them in the name of the trust.

There may be a little confusion about the terminology you are using. A certificate of a trust is a short document that basically confirms that a trust already exists and has been established by the grantor. Have you already had a trust created? And are you saying that you would like to transfer your house and a bank account into a trust?

I have already filled out the form for a trust certificate online.

A trust certificate typically refers to a certification of trust, which is a summary of a trust document that proves the trust's existence and the trustee's authority to manage assets while omitting confidential beneficiary information.

A trust certificate is not a trust. It does not establish a trust. It is basically a piece of paper that says somewhere a trust exists.

So do you already have a formal trust prepared that you have set up, named a trustee, and signed off on all the paperwork in front of a notary public?

Not yet. I haven't set an official trust yet.

Okay. Do you do all of that through this site?

No, the attorneys on the site only answer questions and provide information. We are not allowed to represent customers of the website as clients under our independent contractor agreement. If you are seeking legal representation, you would have to hire a local estate planning or trust law attorney.
