Can I sign a Lady Bird deed for my mother using a durable power of attorney?

I have durable POA over my mother. She is cognitively unable to understand why I chose to do this — to avoid probate and cost. She never prepared a will. She is a widow and I am the only living child. I should be able to sign for her on the Lady Bird deed, correct?

“She is a widow and I am the only living child. I should be able to sign for her on the Lady Bird deed, correct?”

That would be correct, as long as the power of attorney specifically gives you the legal authority to handle property-related and real estate matters for your mother. The question here is whether the POA says that you have the authority to engage in any type of real estate or property transactions on behalf of your parent. If so, then you are in good shape and can execute the ladybird deed on behalf of your mother by signing:

“[Her Name], by [Your Name], attorney-in-fact,” in front of a notary public.

Okay, thanks. Yes, the POA itemizes all property, assets, sales, purchases.

I hope I was able to clear up any questions you had about the situation. It was my pleasure to work with you and help with your question.

Thanks for your information. I feel assured after having foreigners living and working in the U.S. for a matter of months wielding a notary stamp, telling me what they will and refuse to sign — barely 18 or speaking English — making statements up as they go, some not legally correct, even in violation of certain law.

So thank you. I hope this receipt can accompany my effort in getting this done. According to what you have said, I am completely within my right and by her authority. I will add you to my contact/questions list.
