[IN] Can a landlord prohibit firearms after a lease is signed?

In Indiana, landlords ARE allowed to set their own firearm rules in the lease. Indiana does not prohibit private landlords from banning or limiting firearms on rental property. So you get to decide whether firearms are allowed, restricted, or prohibited in your triplex. (IN Code § 35-47-11.1-2)

Indiana has strong firearm preemption laws, but those laws only restrict government bodies (cities, counties, state agencies). They do not restrict private property owners.

That means you MAY:

  • Allow firearms freely
  • Prohibit all firearms
  • Allow firearms but require safe storage
  • Allow firearms inside units but not in common areas
  • Prohibit open carry but allow firearms kept concealed in a unit
  • Terminate the lease if the tenant violates a clearly written firearm clause

Indiana law does NOT say:

  • That a landlord must allow firearms
  • That tenants have a "right" to possess firearms on private rental property
  • That a landlord must accommodate open carry or concealed carry

Indiana treats this as a private contract issue, not a regulated one.

So he just signed the lease. If I don't want to allow firearms, is he allowed to break the lease?

If your lease doesn't currently include any terms about firearms, and you want to add a restriction now, that will be challenging.

Once a lease is signed, both parties are bound by its terms unless they mutually agree to changes. If there's no clause about firearms in the lease, the tenant might not have grounds to break it just because you want to add one now.

However, if you both agree to amend the lease to include a firearms policy, that could work. Otherwise, you may need to wait until the lease is up for renewal to make such changes.
