You have to be careful to withhold the money because that is a different obligation to pay the dues than the HOA responsibility to fix the damage correctly.

You need to look to the HOA bylaws and the rules and regulations to see what it says about dues and payments. It may have language in it about paying dues and any withholding. The obligations to pay dues are a separate obligation you have. So you choosing to withhold the payment could be considered in arrears and then they bring all the penalties associated with it.

You want to formally send writing to the HOA and let them know the facts, that this obligation to put your condo in the place it was before the cutting of the wall is theirs to do. That the painting patching is not correct and doesn’t match the paint before and they must financially reimburse you for this.

About a year ago the plumbers needed to come into my home and cut a hole into my bedroom wall in order to better get to my neighbors pipes. It’s a condominium so our walls are connected. I agreed to let them in and cut the hole because the HOA said they would patch the hole back up and have it painted after the work was done. The problem is the paint doesn’t quite match up with the rest of the wall.

I complained to the Homeowners Association (HOA) and they told me they don’t have to color match exactly although I could have sworn she told me they would before they hired this painter. Recently, I told a different neighbor about this issue with my wall and she said I could hire a painter and take the cost of hiring out of my HOA payment. Is this true and is there any legal paperwork involved?
