Solved

For a New Mexico motion to quash or cancel a bench warrant in Metro Court, you focus on explaining that the failure to appear was not willful and backing that up with specific, verifiable facts about the medical emergency. The motion should include the case caption and number, a short procedural history (traffic citations, prior appearances, posting cash bonds), a clear request to quash or recall the bench warrant, and a factual declaration describing the booking, high blood pressure, ambulance transfer, stroke, hospitalization, and ongoing diabetes complications, with hospital discharge records and witness names attached or referenced.

It is also important to ask the court to set a new appearance date, address any failure to appear charge or license consequences, and explain that she is now medically stable enough to come to court, while noting her Spanish language needs so the court can provide an interpreter. Finally, the motion should be signed, include current contact information, and be filed in the Bernalillo County Metropolitan Court clerk’s office in compliance with local rules, with a proposed order for the judge to sign recalling the warrant. legal-resources.

What must a Motion to Quash a Bench Warrant include in the state of New Mexico, and if the reason is medical reasons but there is no documentation to prove it because the defendant went to the hospital after she was arrested, then released for said medical reasons?

Hello, I’m Legal Eagle. I’m an attorney who works in your area of law and I’ll help you sort this out today. I’ve read what you shared, so let’s go over what’s happening and what your best next steps look like. What medical emergency or symptoms led to the hospital release, and do you have any hospital discharge paperwork, visit summary, prescriptions, billing record, or witness (officer, nurse, family member) who can verify the treatment date and reason for release?

As the defendant was being booked, they noticed her blood pressure was extremely high, and they released her and called an ambulance to pick her up. They never had a police officer with her once she left the jail booking. She actually had a stroke on the way to the hospital, and we do have medical discharge information. Also, family members and nurses were witnesses that she was hospitalized.

The warrant was for failure to appear in court, but she hasn’t been able to work like she used to because of medical reasons. She has diabetes and has issues like this sometimes. She had gotten several traffic citations and had been posting cash bonds after every court appearance. When she went to the county clerk to see if she could pay off the citations or the bond to either extend it or get the citations taken care of, they arrested her right there

Thanks for sharing all that information. It sounds like a really tough situation.

Have you or the defendant had any communication with the court regarding this bench warrant or the failure to appear? If so, what was discussed?

Not directly with the court, only with the county clerk. They aren’t very useful over the phone, and the original county clerk and officer told her to basically turn herself in after she was out of the hospital. When she called again, she was told it’s best to file a motion for the judge, but not to go into the clerk’s office again or she could be arrested. She only speaks Spanish, so it’s difficult to communicate.
