You will need to use an Arizona small estate affidavit.

In Arizona, for a small estate affidavit, it's generally acceptable to use photocopies of documents as proof of ownership. (AZ Rev Stat § 14-3971)

However, if you are presenting the small estate affidavit to transfer the title to the registered motor vehicles, you should have the decedent's original title with you at the time you present the affidavit. (AZ Rev Stat § 14-3971(D))

I am filing a small estate affidavit. Proof of ownership for the personal property must be submitted with the affidavit. Must they be original documents, or can they be photocopies?

I understand that navigating the requirements for a small estate affidavit can be challenging. Can you tell me what specific personal property you are including in your affidavit?

A trailer home, a truck, and a scooter.

Have you already gathered any documentation to support your proof of ownership?

Yes, all vehicle titles.

Hi! Thanks for your question. I'm happy to help. What state are you submitting the affidavit?

Arizona. I mean, my father lived and died in Arizona, so I'm assuming I have to file it there. I live in New York state. Filing here would be easier if that's possible.

OK, that's great. Do I personally need to go to the DMV to transfer the title to me, or can I send a representative? If you know that.

Typically, the person named in the affidavit would need to handle the transfer at the DMV. However, you might be able to authorize someone else to act on your behalf with a power of attorney or you may be able to mail it in. It's a good idea to check with the Arizona DMV for their specific requirements.

OK, this is super helpful. Thank you!
