Ok, then ignoring the potential zoning issues that you could be looking at if your neighbors reported you to the city, you would need a written lease contract with the tenant that sets out how long you are renting to them and what the rent is and any other relevant terms that control what you are allowing the person to use the space for. (765 ILCS 705/0.01) But as long as you have a written lease contract signed by both you and the tenant, you have a binding contract.

You could run into the problem of your insurance denying any claim you might make if there was a loss, like damage or a fire because you are allowing commercial activities in a residential building and they normally deny claims that are a result of business/commercial actions. So it would be a good idea to require the tenant to get insurance that covers you in the event that they cause any damages to the dwelling.
