Solved

Since rent wasn't paid by the grace period deadline on the 5th, you're in a position to move forward. California does allow landlords to serve a 3-day notice to pay rent or quit before starting eviction. The form itself isn't as important as making sure it contains the required information and that you serve it correctly.

For a commercial lease, California law requires the notice to include the amount of rent owed, the property address, and the deadline (3 days from service). You must serve it properly — usually by personal delivery, certified mail, or posting and mailing. The notice must give the tenant exactly 3 business days to pay before you can file for eviction. (CA Civ Pro Code § 1161(2)(3))

One thing that could affect your options is whether your lease agreement has any specific language about how notices should be served or what happens after non-payment

How can I know this is the right form to give notice to my tenant?

I understand that ensuring you have the correct form is important for your situation. What type of form are you trying to verify?

3-day notice to pay rent for an 18-month lease.

Lease rent was due on the 3rd, and we give until the 5th to pay rent. It is now the 6th of the month and still not paid.

Hello! My name is TJ and I’m an attorney. Thanks so much for the opportunity to assist you! I understand how important your legal question is, and I’m giving it my full attention. I’ll share my initial thoughts shortly, and I may also ask for a few additional details. That information will help me understand your situation more clearly so I can offer a more complete and helpful answer.

VERY IMPORTANT INFORMATION:

If you don’t hear from me right away, please know I will always get back to you. I may be researching, preparing your answer, or occasionally dealing with a technical issue, so there can be a short wait between messages. However, your message will stay right where it is, and you’ll be notified as soon as I reply. One quick note: chats are sorted by the most recent message I receive, so sending several short messages (instead of one longer message), or sending a check-in message (like “are you there?”) can shift your chat to the bottom of my list. I apologize for that quirk, and I truly appreciate your patience.

This is general legal info only. Unfortunately, I can’t represent you or form an attorney-client relationship. This also means there is no attorney-client privilege or confidentiality.

A 3-day notice to pay rent is typically the correct form to demand payment before starting eviction proceedings. However, the specific requirements (what must be included, how it's served) vary by state. Once you give the notice, if rent isn't paid within 3 days, you can usually file for eviction.

What state is the property in, and did you serve the notice according to your state's requirements?

Thanks again for reaching out with your question.

Property in Bellflower, California. Rent was due on the 3rd, but on lease agreement we give until the 5th to pay rent, 2 days grace period, and today is the 6th. Just making sure I got the correct form in eForms to serve to lease tenant since it is 1 day late on the rent. Have in mind it is an office, it is a commercial lease agreement for 18 months.
