What should I do if my attorney stops communicating after I accept a settlement offer in a wrongful death case?

Based on your situation, there are several legal arguments and considerations in attorney-client communication and wrongful death claims that could potentially support your case:

  1. Attorney-Client Communication. Attorneys have a duty to keep their clients reasonably informed about the status of their case and to promptly comply with reasonable requests for information. This is part of the ethical obligations attorneys have to their clients.
  2. Wrongful Death Claims. These claims are brought by the survivors of a deceased person against those responsible for the person’s death. The process typically involves proving that the defendant’s actions were negligent or intentional and directly caused the death.
  3. Settlement Offers. When a settlement offer is made, it is the attorney’s responsibility to communicate this offer to the client and to act according to the client’s instructions regarding the acceptance or rejection of the offer.

In November 2025 we hired a law firm to investigate a wrongful death that affected our son. Depositions were taken, and in September 2025 we were notified by our attorney that the other party had made an offer. We told the lawyer that we would accept the offer. That was the last time we heard from the attorney.

We called at least once a week and spoke only with the legal secretary, who told us every time that it was locked in the courts. Once we talked to a real attorney and were told he would get back to us, but he never did.

What would our next action be at this time?

I am sorry to hear about the difficulties you have faced with your attorney regarding your son’s wrongful death case. Have you formally requested an update or a status report from the law firm in writing?

Not in writing, but over the phone many times.

Have you considered reaching out to a different attorney for a second opinion on your case?

No. Would that be a good thing to do?

Is there anything else the lawyer should know before I connect you? Rest assured, they will be able to help with your wrongful death case.

No.
