Solved

If it was non-domestic and you're actively pursuing restoration in Washington, then the key issue is whether your firearm rights have been formally restored by court order, not the fact that the case was sealed. A sealed record does not by itself restore eligibility. Until the restoration is granted, you generally cannot lawfully possess or transport firearms, including across state lines. (WA Rev Code § 9.41.041)

Once Washington enters a valid restoration order, that restoration is typically recognized for purposes of federal law and in other states, including North Dakota, assuming no other disqualifiers exist. At that point, crossing state lines is usually not an issue, but you still must comply with each state's carry and transport laws. (18 U.S.C. § 922)

Federal probation can be imposed as part of a sentence for a federal crime, allowing the individual to serve their sentence under supervision in the community instead of in prison.

When I was 17, I was charged with assault in the third degree. It was sealed. I'm in the process of getting my gun rights back now. I'm just curious, it being sealed, if I can cross state lines or what. I'm from Washington State, and I plan on working in North Dakota.

Is there anything else the criminal lawyer should know before I connect you? Rest assured they'll be able to help with your gun rights.

No.

Hello, pleasure to connect.

A sealed juvenile/assault third-degree charge typically does not automatically restore firearm rights, and crossing state lines does not change that. Your eligibility is governed by the law of the state where you reside, Washington, and by federal law, not whether the record is sealed or where you travel, including North Dakota.

In Washington, a prior assault, especially if it involved domestic violence or resulted in a disqualifying adjudication, can still restrict firearm rights unless you have obtained a formal restoration order from the court. A sealed record mainly limits public access; it does not erase the underlying adjudication for firearm purposes.

Before attempting to possess or transport a firearm across state lines, you should confirm you have completed a valid restoration process in Washington and that no federal prohibitions apply.

It was not domestic, and I'm in the process of getting my rights restored in Washington State. What would cause a federal probation?

If the crime was state level in juvenile court?

State-level juvenile offenses typically do not lead to federal probation. Federal probation is generally related to federal offenses, not state-level crimes. Juvenile court cases are usually handled within the state system, and any probation would be under state jurisdiction.

Does that address your question?

So once I get my gun rights back from Washington, I should be fine then.

Generally, yes. Once your firearm rights are formally restored by a court in Washington, you are usually back in the clear to possess firearms, and that restoration is recognized under federal law. That means you can typically travel to other states, including North Dakota, without the prior offense continuing to bar you. Two cautions:

  1. Make sure the restoration order is fully entered and covers all firearm rights, not limited or conditional.
  2. Confirm there are no other disqualifiers, such as other convictions, active orders, or federal restrictions. Even after restoration, you still must follow each state's carry and transport laws, which can differ.

I believe that addressed your question. Have a wonderful evening.
