I am sorry to hear about the difficulties you are facing at work. Let us go through some steps you can take to address these issues.

  1. Document everything. Start by keeping a detailed record of all incidents, including dates, times, locations, and any witnesses. This includes the breach of confidentiality, racial microaggressions, and any instances of retaliation or hostile behavior. (42 U.S.C. § 2000e-2)
  2. Review company policies. Check your employee handbook or company policies regarding confidentiality, discrimination, and retaliation. Understanding these policies can help you determine if your employer has violated any rules.
  3. Consider external reporting. If internal reporting is not an option due to lack of trust, consider filing a complaint with external bodies like the Equal Employment Opportunity Commission (EEOC) for discrimination or the Department of Labor for confidentiality breaches. (42 U.S.C. § 2000e-5)
  4. Seek legal advice. Consult with an employment lawyer who can provide guidance specific to your situation. They can help you understand your rights and the best course of action.
  5. Explore alternative dispute resolution. Mediation or arbitration might be viable options to resolve the conflict without going to court. These methods can be less adversarial and quicker.
  6. Prepare for possible outcomes. Be ready for different outcomes, including potential changes in your work environment or relationships. Having a plan can help you manage stress and uncertainty.

My employer failed to protect sensitive employee information during a drug test collection on site. I was able to overhear other staff members’ positive breathalyzer results and the last four digits of their SSN, and others were able to hear my SSN as well. Furthermore, when placed on leave for the positive result of my drug test, I endured a racial microaggression, was accused of recording when I was not, and was treated in a hostile and unprofessional manner.

I'm sorry to hear about your experience; it sounds very distressing. Can you tell me if you have reported this incident to your employer or HR department?

HR is the person who was present and committed these actions.

Have you experienced any retaliation or further issues since the drug test and the microaggression incident?

When I ask for leave or fill out purchase or travel requests, they are scrutinized more heavily than others. They throw the book at me more.

Is there anything else the Employment Lawyer should know before I connect you? Rest assured they'll be able to help with your hostile work environment.

I do not trust HR or my supervisor since they failed to address the breach of confidentiality and hostile, toxic work environment.

Based on your situation, there are several legal arguments and considerations in employment law that could potentially support your case.

  1. Breach of confidentiality. Employers have a duty to protect sensitive employee information. If your employer failed to maintain confidentiality during the drug test, this could be a violation of privacy rights.
  2. Hostile work environment. A hostile work environment is created when an employee experiences discrimination or harassment that makes it difficult to perform their job. The racial microaggression and unprofessional treatment you described may contribute to such an environment.
  3. Retaliation. If your requests for leave or other work-related matters are being scrutinized more heavily as a result of your complaints, this could be considered retaliation, which is illegal under employment laws.

Let me know if you have any questions or clarifications. If not, I will move forward with guidance.
