Does the heir in my will have to be a family member?

I am writing a very simple will in Michigan. I chose not to use the Statutory version because I want to name a single heir who is not a child or close relative. I have no children. I am married but if we die in an accident together, or he proceeds me in death, we only want one person to inherit all the residue of the estate. We also want this person to be our personal representative. Is this allowed?

I understand you are looking to create a will in Michigan with specific instructions. Are you looking to name a non-relative as the sole heir and personal representative of your estate?

She is a second cousin, but yes, we want her to be sole heir and personal representative.

Have you already identified the individual you wish to name as the sole heir and personal representative in your will?

Yes

Is there anything else the Estate Lawyer should know before I connect you? Rest assured they’ll be able to help with your will creation.

No

You are able to name anybody you want to leave your estate too. There is no requirement to only leave it to relatives. Neighbors, friends, people in need are all fine to name in your will.

Ray

Yes an heir can be personal representative. You can also name friend, neighbor, or someone you know and trust.
