Thank you so much for chatting with me on this. Texas does not set a fixed number of originals required for a Durable Power of Attorney, but you should have at least three originals signed, one for each person involved. The principal keeps one original, the agent keeps one, and the co-agent keeps one. You can also make certified copies for any banks, financial institutions, or other third parties that may require proof of authority. (TX Est Code § 751.0021)

Most institutions in Texas will accept a certified copy rather than an original, so having a few extras on hand is practical. Go ahead and make at least two to three certified copies beyond the originals so you have them ready if any institution requests one. (TX Est Code § 752.001)

Does that help clarify things? I want to make sure I didn’t leave anything out.

I understand that navigating the details of a Durable Power of Attorney can be confusing. How many individuals are involved in this arrangement?

Three.

Are you aware of any specific state laws that might affect the number of originals and copies needed?

Not that I am aware of. I am in Texas.

Hello, I’m Legal Eagle. I’m an attorney who works in your area of law and I’ll help you sort this out today. I’ve read what you shared, so let’s go over what’s happening and what your best next steps look like. Does the Power of Attorney name one agent, or does it name co-agents or successor agents among the three individuals?

It names two. The agent and one co-agent.
