Solved

Any potential witnesses who might qualify as disinterested could include neighbors or acquaintances who aren't related to you or have any interest in the estate.

One option might be to contact a local notary public or a legal professional in the nearest town. They often provide witnessing services and might be able to assist you. Another possibility is to check if there are any community centers or local organizations that might have volunteers who can help.

Texas Small Estate Affidavit Form

Full Conversation

I am going to file a small estate affidavit. It says I need a disinterested witness. Do these people have to know me, or can somebody there witness? I don’t have anybody that knows me that will go with me other than my husband. My family and friends work and they live out of town.

Hello. My name is Richard and I have been a licensed attorney for over 25 years and hope to be of assistance. I understand you're dealing with filing a small estate affidavit in Texas and need a disinterested witness. Could you tell me more about any steps you've already taken regarding this matter?

I downloaded a form and purchased online.

I don’t have anyone around me that doesn’t work, nor do I feel comfortable asking someone to take 3 hours out of their day. I live 1.5 hours from the nearest town.

Do the disinterested witnesses go to court with me, or just to the notary?

Richard

Richard

The disinterested witnesses typically only need to be present for the notarization process, not in court.
