Generally, both parents have the right to spend time with their child, and any interference with agreed visitation can be a violation of these rights. Courts typically prioritize the child's best interests, which often include maintaining a relationship with both parents (FL Stat § 61.13 (3)). You can also consider keeping some of this information for court, and you could request temporary orders so you can see your child soon.

Florida Custody (Parenting) Plan

Full Conversation

Have I included information that the judge will not appreciate or will be considered inappropriate? As I'm sure you can see, I am very emotional, and I don't want to submit a document with information that could cause me problems. I just want my child to be safe, and I'm not sure her mother is able to provide her with a safe environment.

I understand how stressful it can be to ensure your child's safety and the importance of presenting the right information. Can you tell me what specific information you are concerned about in your document?

You can't see the parenting plan I filled out?

Have you already submitted this document to the court, or is it still in the preparation stage?

Preparation stages.

Hi there! Welcome. My name is Liz and I’ve been an attorney for more than a decade, and I am here to assist with your legal concerns. Just so you are aware, our service is a legal information-only site. No attorney-client relationship is formed from our conversation. So I can best help, what information did you include?

Honestly, it was probably way more than I should have. I included information about my wife's multiple affairs, inappropriate conversations that she had with my daughter, information about a DCF case which could have easily prevented us from being reunified, and basically a lot of emotionally charged information.

Liz

Liz

Have you already filed it?

No. I just prepared it.

My wife is not allowing me to see my daughter for our agreed-upon visitation days. She keeps changing it, and in turn this is preventing me from spending time with my daughter. She is gaslighting me and trying to say that I'm not considering my daughter's best interest.

Liz

Liz

Got it, thanks. That would mean that you can still make changes. The affairs may not be relevant necessarily, but if she is introducing the child to all these new people, that can be a concern. What happened with the DCF case?

Which is not at all true. My daughter's best interest is to have time with her father.

Liz

Liz

Which is also true.

We were reunified, but I caught her having an affair with my counselor that DCF assigned me and was told that if I say anything that it’ll cost us custody of our daughter. This was supposed to be my advocate, and I trusted him, and my trust was manipulated, and because of that I remained quiet.

Did you ever consider reporting him now to the licensing board?

Okay… so I'm going to remove all of the emotional information and remain focused on the issues I'm having with visitation, but I will keep the information that I wrote out in case I need it in the future.

I did, but I wasn't sure how to go about doing it.

Liz

Liz

Which state are you in?

On top of that, when I contacted his supervisors about it, they ignored me. I felt like I was starting to look like a problem, or maybe they thought I was making assumptions, but they both admitted to the affair, and because of it he quit his job. I recently found out he is working with children and families with a private company that works with DCF.

Florida.

Is he a licensed social worker, or what kind of counselor?

Yes, he is a licensed social worker. I did some research and found out he would have his license revoked and would be facing prosecution if I was to report him.

That's because an affair with someone in an open case is a serious ethical violation. It can be reported to the Florida Board of Clinical Social Work, Marriage & Family Therapy and Mental Health Counseling.

It's been a few years though, but I did find out from my wife that this wasn’t his first affair with a mother, and I worry that I'm in turn allowing him to hurt more families by not reporting him.

I can’t live with this burden. I need to do something so that he is not allowed to hurt another family. Thank you for your help, I now understand what I need to do.

I'm glad I could help.
